Hi I recently posted about my work capability assessment which was on the 28/1 and was awarded LCWRA at that time but my initial application was tendered August 2022 but the award started after the assessment what about three months prior to assessment I have tried to ask universal credit and depending who reads the post I get different answers from all over the country. Please help.

I just seen your previous thread here https://forum.scope.org.uk/discussion/101039/hi-my-name-is-stirling-what-can-i-expect-from-my-work-capability-assessment#latestI see from that thread that you did previously have LCW but reported a worsening of condition. As advised in that thread the waiting period doesn't apply to you because you already had LCW.Therefore the extra money should be paid from the assessment period in which you reported the changes. What date exactly did you report the changes? and what date do you usually receive your money each month?

Hi there thank you very much for your reply and being patient with me as I have a brain in jury the effects of which are worsening having no short term memory and repeating myself often.0

sorry I first reported the change on the 28/08/22 and I usually receive payment on the eighteenth of the month.0

So your assessment periods are 12th to 11th of each month. This means that the extra money should be paid from assessment period 12th August to 11th Sept and your first payment would be 18th Septemeber.Put a message onto your journal under the payment section and remind them that you reported the change of health condition on X date, therefore the extra payment should be from X date.1

Thank you I have just done this and now awaiting reply I think they have a list of rubbish reasons why you can't have particular benefits thank you very much for your help0

Hi Poppy 123456, I did what was advised and received a telephone call from the same guy I was talking to on my journal and after forwarding the info you advised he said that it is not usual to give back pay but he would ask for a mandatory reconsideration, where do I go from here please.0

The person you spoke to isn’t correct with their advice. If you report changes then the extra money is paid from the assessment period in which the changes were reported.
If it was a review started by DWP then no money is owed.
You can request the MR on your journal for the decision not to award you the LCWRA element from the Aug/Sept assessment period. (AP) Tell them that you reported a change during that AP and you believe the extra money should be paid from that AP.1 -
Thank you so much a mandatory reconsideration is in progress. Stirling.0

Hi poppy 123456, after following your advice to get a mandatory reconsideration it was found in my favour and awarded to me with 7 months backpay which was credited to me yesterday but I still await the credit thank you for your help and advice on the matter I will advise when I get the money1

That's great news! Although they shouldn't continue to get this wrong and they should know the rules, when so often they don't. Thanks for the update.
