@onebigvoice this isnt referring to a pip or dwp assessment it is a care needs assessment done through the local authority and nothing to do with claiming benefits
It looks at providing aids and adaptions and care plans and if there is a need for these then a financial assessment is done to determine if the person needs to contribute to the cost
I'm presuming as the op has sufficient savings they are refusing as they expect them to be able to cover the cost
@Wibbles I'm not saying you are not entitled to an assessment . If I remember you are wanting one to get some care do your wife doesn't have to do everything for you,?
Can you not get a list of care providers in the area and contact them by email to see if they can assrss your needs1 -

They may deal with hundreds of applications a day for access to benefits but, what are you supposed to do when that persons opinion of whether you should receive an assessment is based on exactly that?
Other I have dealt with have more serious problems than you, and they are not claiming? Is a classic answer.
I cannot give to much advice since I am on a two strike warning, yet everything I have stated is correct.
Ring again and if you have received a letter saying you need an assessment or you have already been granted funding, types of letters see who is on the bottom and ring them, if its from the DWP or Pip's then re-ring and ask them why you have been refused an assessment, as you will make arrangements for an assessment from the people that already treat me? and just send in that report.
Is it to much to ask for an assessment by the people that are being paid to give you an assessment? and write a report on you?
In any case - this thread was started by myself - so I don't understand what you mean by "This was part of my initial post..."

@Wibbles , maybe ask your GP for a referral to your local Independence Team, they may react to that. They will then do the initial assessment & refer on from there.My financial situation didn't come into it with both the Independence & Adaptions assessments. Finances only came up after the OT sat down to discuss what was actually needed. If I was able to pay, then she could still set the ball rolling.0

I have a GP appointment in 4 weeks so yes I will do this

I haven’t used Access Social Care but plan to in the next week for my own care plan issues.Access Social Care is a charitable organisation that offers free legal support. They may be able to help. Their email address is enquiries@accesscharity.org.ukand their website is linked below.
Free Legal Advice for People That Need Social Care in the UK (accesscharity.org.uk)
I have however used the Disability Law Service in London on a number of occasions. The solicitors there are great as they tailor the advice to your individual situation and I have asked for written advice by email to supplement the call which I have found very helpful.
Their community care helpline is now on the number below (no longer on the main DLS law service number given on the internet)
0207 791 9809
2 - 5:30 on Monday, Wednesday and Friday
I strongly suggest you call as early as you can as the lines are often oversubscribed and if they don’t answer your call you will have to call again the next time the line is open
Finally there is CASCAID - The Centre for Adult Social Care Advice Information and Dispute Resolution which from briefly skimming the site seems to have a care act focus and offers help online. I plan to try their service out to see how useful it is with my needs assessment situation which is complex. So cannot comment yet on how helpful it will be but it looks promising

Still no sign of a care needs assessment !!Its now been 7 months since I applied for one
I worry about my wife/carers health and what I should do, should my wife ever get ill.
I am UNABLE to do ANYTHING myself and if my wife was unable to do anything either
Even if I was able to raise an ambulance (using RELAY if necessary) – what would I then do ?
How would I even survive ?
We have NO relatives or friends close by who we could rely on for assistance.....
I can't be alone with this potential problem - what do other people do ?

It sounds like a very vulnerable and frustrating position to be in. You need to get legal advice and act on it. I gave you the phone number for the disability law service in London. Perhaps someone at the CAB can instigate the official complaints process for you. There is an ombudsman you can go to after that is exhausted. It can be a fight to get a proper needs assessment done. I am in the process of such a fight myself and in addition to advice from the disability law service am using a specialist advocacy service that does statutory advocacy for needs assessments. Carer’s organisations may also be able to advise - where I live there is an organisation called Carers Count. Please google statutory care act advocacy for your area. I hope you can get the support you need to finally get your needs assessment.1

I have just googled letters to formally request an adult social care needs assessment and got this document from the disability law service

If you decide to do this it may be an idea to refer to the already sent letter from the CAB as well as enclose a copy of this letter for ease of reference - I remember you said the CAB was helping you some time back.

I wish you luck with all of this let us know how you get on.I have received a response from the council person who I assumed was dealing with my "care needs assessment" application telling me to apply to a different team rather than her as she is not a part of the triage team this week and is due some annual leave, therefore emails may get missed.The team and managers responsible for allocations are aware of my needs and have been updated with the information that I sent. An allocated worker will be in contact with me directly once assigned my case.
Should I wait or be proactive ?
CAB are waiting on the result of my formal complaint - which is due on 11 April...

Perhaps chase it after two weeks of that discussion and then once or twice a week thereafter doing it all in writing so as to leave a paper trail.I’d personally seek out a statutory care act advocacy service now in any case who would use their own judgement. Even if you are granted a needs assessment you may benefit from the advocacy service supporting you with the needs assessment and care plan process.
I also strongly suggest you of your own accord go through all the eligibility criteria and 9 areas of well being under the care act - write out how your needs fit in with this. I did send you info on how to do that before.Once you have written it out you can then bring that to the advocacy service and the needs assessment and they must take it into account. Very easy for the council to down play some of your needs otherwise.I can try and find a link to a summary of the key areas under the act, but you will need to bear with me a bit as things are hectic for me at present. Would you like me to find this info for you?This is just my opinion… as a person who has been through it a number of times and has had to fight for services.0 -
