ESA have stopped my money, as I am doing permitted to work I have made sure I stay below hours and wages but last month my employer paid me £370 (for holiday owed last year, I only work 6 months of the year). This then took my wage over by £2 weekly for permitted earnings so they just stopped my money. I also got paid 25 hours for holiday owed for this year (all keeps me below the amount allowed over weeks I have worked.

Bit the £370 takes me over by 2 pound a week.
this is causing my pain levels to increase and I honestly can’t take the stress much more
i have done a mandatory consideration l. How long does this roughly take and will they be allowed to include the £370 on this year, my employed wrote a letter to go with my mandatory reconsideration to explain it was owed for last year and it was even on its own wage slip

Permitted work rules are very strict, if you earn more than the maximum amount then you won't be entitled to ESA and it will end. It makes no difference that it was for holiday pay for last year, it will count in the month/week you receive it. If you only work 6 months of the year then it would have been better to have been paid it when you're not working.It can take anything up to 12 weeks for a decision on the MR. Yes, they can include the holiday payment for this year.I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.If i see a question that i know the answer to i will try my best to help.

Read on their blocker thing that if the holiday was paid after 4 weeks or gap in employment they couldn’t count it?Paragraph 41026
