PIP is going to be stopped before the awarded letter date

Hi, 

I got my pop in January 2023 and letter stating that I should get award till 2027. But now when I rang them and asked them about my pip they told me that my pip is going to stopped and have to start the process again and provided number to call and start again. Is this normal? I should get my pip till 2027 but within 9 month it stopped. Did you face similar problems? Any advice?

    Did you ring them to tell them about a change of circumstances?

    PIP can be reviewed at any time before the award end date, but for it to be reviewed so soon in this case, it sounds like something must have triggered that.

    I have been outside of the UK three to five times and before leaving I notify them of this.  Each visit lasted less than 3 months.

    So just to clarify, you have been out of the country a few times since January 2023 when you received PIP and you informed the DWP each time. You said you called them up to check on your PIP and they said that your PIP was going to be stopped?

    Did they give any further details?

    How long in total was all the time outside the UK, you say each was less than 3 months but it's possible the total time may factor into the decision so knowing that would be helpful.

    I'm also going to move this to our PIP section so people who are more knowledgeable about PIP can see it more easily :)

    I think in total it's more than 3 months. But as far as I know and when I spoke to pip representative first time they told me each outside visit should not exceed 3 months and it's not cumulative.

    Letter did not say any reasons. They provided number to contact the person.

    When I called them they said it might be mistake from their side but told me that some one would contact me in regards to this via my number but so far no one contacted me.

    I would contact Citizen's Advice, they have information on why PIP can be stopped and what to do here. I can see they do say it will be stopped if you are abroad for more than 13 weeks, it says nothing about it being cumulative over the year.

    Hopefully you can find out the actual reason behind the stop.

    Hi @pip87 - as far as I've seen, you only need to report a change of circumstances with PIP if going abroad for more than 28 days. You can go abroad for 13 weeks (which you'd have to report) or 26 weeks for medical treatment.

    But there is no mention that  13 weeks absent allowance is for a year.

    If that the case I have to ring them . Any experience what they could asked and what reply should we give to restart the pip payment?

    I agree, there's nothing to say that's an allowance for a year. I hoped to give you some ammo for when you next make a call. I can't see you've done anything wrong, & it looks like an error on their part.
    They certainly can't disagree with the Social Security regs, & the 2nd link is to the ADM (Advice for Decision Makers) based on the regs!
    I don't know anymore than you why you should be forced to make a new claim when you have an award until 2027. I hope you can call back & get this resolved.

    Thanks. Plus when I spoke first to their representatives one of them told me that it's 13 weeks is one go not cumulative.

    Unfortunately when you ring, you're just put through to call handlers, & tho the first one you contacted got the advice right, we've heard of many that give dreadful 'advice.' As I say, nowhere can it be found that it's only 13 weeks in a year, just each time. 
    Just say they need to check the Social Security (Personal Independence Payment) Regulations 2013 regulation 17(1).

    So if I mentioned this regulation then they don't have to say anything ? Because this regulation does not say this 13 week allowance is once in a year !

    Or could you advise what should I say to case worker when I rang them ?

    I don't think there's much they can say if you quote the regs.
    If you are absent from GB for longer than 13 weeks, then PIP stops, but you can be temporarily absent (as in you're on holiday, business, or whatever reason) for 13 weeks without it being detrimental to your PIP at all.
    It sounds a bit daft but you're treated as if you were still in GB (so not a reason in this case for your PIP to stop) because you're classed as only temporarily absent!
    The important bit is that legal terminology has to be very precise. If this regulation meant that you can only spend 13 weeks in any year abroad, then it would say so, but it doesn't!
    Ask the case worker to reinstate your claim. Any problems & quote Social Security (Personal Independence Payment) Regulations 2013 regulation 17(1). The DWP cannot go against such regs, in fact they're quoted in the ADM link above, which is the manual that PIP decision makers use, based on the law.
    I'm sure all will go well, but it would be good of you to let us all know.
