Hi I am new on here.

I would like some advice about PIP please.

I got awarded PIP in May 2023 I have not been well due to my mental health and other issues. I have just come across that I could appeal my PIP award with mandatory reconsideration but I needed to do this within 1 month. But I am 6 months from my award letter.

Can I do MR now and give reason that I was not aware that I could do a MR but now I have become aware after speaking to Scope adviser?

Also what are the chances that PIP will accept my MR?

Because its been 6 months since award is there a possibility that DWP could ask for me to reassesed by Atos again and start the whole claim process?

Many thanks.

You have 13 months to request the MR. As you're outside of the 1 month timeframe then yes you will need to give a reason why you didn't request it within the first month.

If they refuse then you proceed to Tribunal. Most MR decisions remain the same anyway but there's more chance at Tribunal stage, providing you either choose to appear in person or have a telephone/video hearing.

Please also be aware that they will not be able to take into consideration any worsening of condition since the original decision was made.

Is the above for MR or tribunal? Will they take into consideration new conditions since original decision?

It applies to both the MR and Tribunal. If it's a new diagnosis (which PIP isn't about anyway) and you already mentioned the issues with that condition then yes it's fine.

If it's a completely new condition then i'm afraid not.
