Looking for advice about LCWRA timings

Hi Im new to the group been off work forgoing on 2 years following an accident doesnt look promising to return to work anytime soon, i wasa joiner for 35 years.

    I claimed Uc in December 2021 and recieved  standard allowance for 6 mnths then went to my sisters in Spain for 11 months to recuperate so rightfully ceased the claim. I was also awarded PIP standard allowance whichhas been constant. On return , June  2023 to UK i claimed UC again and put in my Fit note as requested,(which states "you are not fit to work"). I was advised to claim  LCWRA by DWP, so i did and a video call booked for 23 Septmember 2023 which was cancelled due to doctors strike, i had an assesment over the phone on 9 October 2023, i really dont understand the timings of LCWRA is it from assessment date or Fit note date, and also dont understand why it wasnt advised to be applied for from the offset of mt original claim. The accident i had has left me with permanent disabilities which was clearly obvious from day 1. Any advice would be gladly received.

    If found to have LCWRA the waiting period starts from when you reported your health condition, providing you sent a fit note within 7 days of that and continued to send them without any gaps until a decision is made on the work capability assessment.

    Your first payment will be either Oct or Nov. The exact date will depend on what date exactly you reported your health condition/provided your first fit note and what date your assessment periods cover, or what date you usually receive your money each month.

    Even if you were advised to report your health condition when you first claimed UC in 2021 because your claim ended and you were out of the country for 11 months, then that decision wouldn't apply now anyway because it was more than 6 months that your UC claim ended. You would have still needed to go through another WCA.

    Thanks Poppy seems a little clearer I have given fit notes as per requirement without any breaks so I suppose I should hear something pretty soon .

    Hi @GrantABC if it is any help I had my assessment on the 10th of August and had my decision letter on the 14th September, I can't say about how far after the payment can arrive as I have memory problems and forgot to upload my last sick note so there is a break 🙈 hope this helps

    Decisions can be up to 12 weeks. Though a lot of people have a decision much sooner than this. Some receive it within just a few days.

    Just an update I was notified through DWP journal on 8 October that I've been classed in LWCRA I received first payment of £390 on 18 October and am being paid a month's back pay on 4 December so I'm very happy with the acceptance of my current health situation. One major thing to do is fully list your ailments,treatments and ongoing condition updates through the journal, I felt this helped the assessment processor  make their decision with clear information.(not to date received it in writing)
