Good morning I did my Mr over the telephone rather than form, is it correct that this will not be included in the bundle if I don't get the points and need to go to tribuneral, as I know the form would thank you in advance

    Hi @Jon7777777, first of all well done on your MR (I still have to do mine, real life has got in the way a little).

    I'm happy to be corrected but from what I understand the person you talk to over the phone fills/writes out a form/template they have based on what you say over the phone. They may not transcribe exactly what you've said, that is why it is much preferred to send in a letter. But whatever they put down should find it's way into tribunal materials.

    There is nothing stopping you from sending in a letter as well by the way, to ensure that nothing is left up to interpretation.

    Yes, something called a 'statement of dispute' is typed up by the call handler who then adds this to the relevant box on your file so will be included as part of any potential bundle. I strongly recommend that you write an MR up too if you can as well as the one taken by telephone.

    I received a letter saying my Mr would be reviewed by the 2nd January I have received nothing did they send it and was lost in post? Any advice much appreciated

    Hi @Jon7777777 Unfortunately, there's a big backlog, so any dates they give may not be correct. Can you call to ask for an update?

    Aww thank u, am not sure, I would presume if it was posted I would get a sms message like I did when they received it

    They don't send text messages when a letter is sent out to you. The date they gave you to tell you when they hope to look at the claim by is just a guide. It doesn't mean a decision will definitely be made by that date.

    Aww ok thank u poppy, I did get a sms when they received it so just presumed they would do the same when posting, as if it did get lost in post u would never know

    Do the dwp mind people phoning up for an update as I feel uncomfortable doing it, it's like chasing or desperation thank u

    Not at all @Jon7777777 they're very used to it by now. Please don't feel uncomfortable, you're just trying to find out vital information that they've not already sent you.  :)

    Well I phoned up today and was told the decision was sent out on the 4th of January no more points awarded, I said but I have never received it, so either it was never sent out or lost in post, she read out the decision over the phone and this is why am confused, the reason given why prompting for nutrition was not awarded points originally   was for 1 reason medication was effective, when I put my Mr in all I stated was I don't take medication for eating disorder so it's my opinion points should of been given but now the decision does not mention that but gives another reason why I never received points for prompting I said to the lady why was that reason not mentioned with medication  as If it had of been i would of addressed that issue as well very confusing, she said she would post out the decision letter again and do a second Mr and asked me to send evidence in that I gave not already done to address the second reason this is ridiculous 1 reason why points not awarded which I quite clearly proved to be untrue now a another reason why points not awarded what's going on help much appreciated

    You can’t request another MR because you’ve already done that process. 

    You can now request the Tribunal and you can do that online. As you will be outside of the 1 month timeframe you will need to give a reason why you didn’t request it within the first month. Not receiving the decision letter is a good enough reason and the Tribunal are highly unlikely to refuse a late appeal.

    Thank u poppy but if I can't have another Mr then surely the second reason mentioned later should of been included surely it cannot be right to with old reasons and add them later
