Hi all

Phoned esa about sdp as our children have now left home me and my husband both get enhanced rate pip my husband gets contribution related esa in support group and industrial injuries benefit and constant attendance allowance I only receive pip no other benefits . We are both under pension age . Lady on phone filled out form and said pleased to know it's gone to declaration page . That was 8 weeks ago and havnt heard anything does anyone know if we entitled to it thank you

    The disability premiums are only payable with Income Related ESA. They can be paid as a top up on contributions based depending on circumstances. For the income related top up to be included he would need to fill out an ESA3 form and include you in the form because you would need to be named on that claim and entitlement would be based on your joint circumstances.

    As he's claiming IIDB then this will be treated as income and it will reduce any Income Related top up (disability premiums) £1 for £1. Whether there's any entitlement will depend on how much IIDB he receives per week.

    He's on £310 a week IIDB and £83 of that is constant care allowance which they have taken taken off his pip enhanced rate

    Can I please just check that his ESA is currently £138.20/week?

    Thanks. The calculation for Income Related would look like this..

    ESA couples £142.25

    Support Group component £47.70

    Disability Income Guarantee couples (known as Enhanced disability premium) £29.75

    SDP couples £163 Total weekly amount = £382.70

    IIDB £310 - £83 = £227 - £382.70 = £155.70/week ESA payable. This means an increase of £17.50 per week.

    Are you also aware that you will not be receiving any NI credits towards your state pension.

    There's another option which will give you more money each week, you could claim carers allowance for looking after your partner. You would lose the couples SDP and that would revert to single person so there would then be no entitlement to Income Related top up. Carers allowance will be £81.90/week and can be backdated for a maximum of 3 months. You would then also receive class 1 NI credits for your state pension. https://www.gov.uk/carers-allowance/eligibility Many people claim PIP their self as well as carers allowance for looking after someone.
