Carers element confusion
Hi everyone, I’m new here and was wondering if someone were able to help me with my query? My husband currently claims carer’s allowance for me and as a result we get the carer’s element of universal credit. Our son has just been awarded middle rate care of DLA due to autism. Does that mean we can add an additional carer’s element to our universal credit claim? I’m getting conflicting answers online. TIA

As your husband already claims the carer element of UC, he would be unable to claim it a second time for caring for your son. However, if you care for your son the 35 hours a week, you could claim the carer element. The exception to this would be if you have an LCWRA award, you wouldn't receive the carer element too.

People on LCWRA can also receive carer element.

That's not correct. The same person can't receive both carers element and LCWRA element at the same time. In this case only the higher element is paid, which is LCWRA. See link and scroll to F6034
