Housing Benefit - LWCA

Hi
I don’t know if this is the right section - so my mum recently has come back to live with us to care for my brother. They have asked us to fill out a review form for housing benefit.
im a non-independent and claim universal credit and pip (I believe my universal credit it in two parts standard Universal credit and Limited capability for work and work-related activity).
In the housing benefit form they have asked what “income” I earn. In it they have mentioned PIP. However, from my understanding PIP and LWRCA doesn’t and shouldn’t count towards Housing benefit assessments.
My question is: when stating my income do I just mentioned my standard universal credit or do I need to mention the LWRCA and PIP as well? Or do I not include them. I assume they know what I get in terms of amounts.
Or do I just state there is no change in my income as my circumstances haven’t changed and just provide them with my mums details income etc.

I’m a little confused by your question despite reading it quite a few times. You mention your mum going back to live with you. Then mention you are claiming UC but then ask about housing benefit saying you are the non dependent.
To be clear who is claiming for help with the rent? Is this you because your mum has come to live with you?

Hi
apologies for confusion so because of my mum they are doing a review form for housing benefit.
in that form online it states the people living in this house which includes me.
they have a summary of my income which includes the standard universal credit and states my PIP but makes no mention of the LWRCA complement.
from my understanding the Pip and LWRCA don’t count towards income and is there a need for me to mention this? Hope that made sense apologies again0 -
I’m sorry but I’m still confused. Who’s claiming for help with the rent? You or your mum? You didn’t answer that question. This is what I’m confused about because you said she’s moving in with you so I would expect you to be claiming for help with the rent through UC known as housing element and not through housing benefit.
Your mum can’t claim for help with the rent if she’s living with you unless she’s named on the tenancy agreement.

Hi
She is on the tenancy agreement - always was but she separated from my dad and came back recently to look after my brother. Her name was always on there. She gets a very small state pension.
however, in the review they have asked for my income information (non dependent) and it’s my section that I’m confused about whether I need to tell them about the LWRCA element or the PIP.. or do they get that information themselves. Currently they don’t have the LWRCA element on the information they sent me.My mum will fill out her information and I believe she has applied for pension credit but no idea what is happening with that. It’s my section I’m confused about and whether I need to update them as from my understanding the LWRCA and pip don’t count towards income when they are making their assessments.
I honestly don’t know much about how process works.

Thank you, that makes sense now. If you had explained that she was returning home then I would have understood because I thought it was you that was claiming for help with the rent. Sorry for the confusion.
If you are 25 and over there will be a non dependant deduction of £19.30/week unless she claims a qualifying disability benefit herself such as PIP/ADP daily living, DLA mid/high rate care or AA and then there will be no non dependant deductions.
If she doesn't claim a qualifying disability benefit and you're under 25 there will also be no non dependent deductions if you do not receive any earnings because you're claiming UC.
You just need to tell them you're claiming UC and they may ask for a screenshot of your statements. If you don't receive any earnings there will be nothing further to tell them.

thanks poppy much appreciated sorry for confusion.
just to clarify I think she gets 100 pounds a month state pension and she has applied for pension credit. She doesn’t get pip etc. I’m over 25.
if she doesn’t get pension credit I assume she needs to pay 19.30 a week (is that right)? Can I ask - in the form they have asked if anything has changed for the non dependents (ie me). Silly question but on the computer screen it states that I get standard universal credit and pip and mentions the amounts. However, there was a recent rise - do I need to tell them? They already know I’m on universal credit but nothing was mentioned on the screen about LWRCA. Do I need to tell them about that. From what you wrote iy seems the fact they know I get universal credit is enough and I don’t need to tell them about the amounts.
the one thing that has confused me when the universal credit went up from 317 to 390 (ie government increase) I assume they know this and don’t need everyone to update them on this?Sorry if my question is silly I’m worried because they haven’t mentioned the LWRCA element will I get in trouble.

You're welcome and no worries.
There will still be a non dependant deduction whether she receives pension credit or not. If she's a single person there will be entitlement to pension credit if £100/week is her only income and she's not receiving any other pensions.
You can tell them about the LCWRA element but it will make no difference to the amount of deductions if you or partner if you live with one, receive no earned income.
See link.
please note.. the part in that link where it says "no deductions will be made for someone who receives pension credit, is referring to non dependants and not to the claimant. (your mum)0 -
Thank you so so so much! I read slowly what you wrote and sent.
Final question I promise!
so because my mum is joint tenant that link you sent says she is NOT a non dependent. So there will be a deduction of 19.30 a week regardless of pension credit. I’ve read what you wrote - I hope I got it right
thank you again for being so patient0 -
You’re very welcome. Yes, you read that correctly. 😊
