Mandatory Reconsideration
Good afternoon, have just got the text this morning to say my review is complete and that I will get a letter in 2 weeks.
I have rang the helpline and the AI says I will be paid £303 on Friday. Looking at the rates it is only the higher mobility rate I will be getting and no daily living.
If I was to do a mandatory reconsideration for the daily living part am I at risk of losing the mobility or will that still be awarded

Hi @zimmerman, welcome to our community 😊 You can put in for a Mandatory Reconsideration after receiving your decision letter. If you put in for the Mandatory Reconsideration then they will re-assess the entire decision again, which means they could decide to score you less points yes. You would still be able to go to appeal to a tribunal however as the next step. You can read more about the appeals process here: Appealing a benefits decision | Disability charity Scope UK

I wouldn’t take too much notice of the payment information because it’s very often incorrect.
You can ring PIP to ask what the decision is and they will tell you. Otherwise please wait for the decision letter before deciding on your next steps.

I'm sorry but I do not give advice through PM because I don't have any spare time to do that. Not only that the scope team do not like advice being given this way.

Was wondering about toilet needs, I use a commode and a bottle as it's difficult, painful and time consuming getting up the stairs to use toilet. I've been awarded 0 points for toilet needs. I just need those 2 points to be awarded the low daily. Would that not be classed as using and aid and obviously someone emptying them for me classes as needing help?

Hi @zimmerman - perhaps I can help with your query about toilet needs. It can be argued that needing a commode should only be considered if you have problems with continence, i.e. if you have such problems with urgency that you could not get to the toilet in time without becoming incontinent, then the use of a nearby commode would potentially help you gain points with this descriptor/activity.
Unfortunately difficulty in actually getting to the toilet is more considered as part of the mobility component; it's how you actually are once you reach the toilet, e.g. do you have any difficulty getting on & off the toilet, & can you effectively wipe yourself clean? Do you have grab rails to help you get up & down from the toilet, or do you need someone with you to ensure your safety?
Do you think there's another descriptor where you might gain extra points in the daily living component instead?
