PIP

I made a claim for the first time for PIP but I think I massed up the assessment. I am claiming for both chronic migraines and dyslexia (sorry if misspelled anything), I am diagnosed for both. When I had the assessment, they asked if I can take a bath or prepare food and I said yes but I have to have someone read the instructions and the ingredients to me so not sure if that was right because later she asked if I can take a bath or prepare food when I having a migraine and obviously not because I do not no what I am doing and I just need to sleep and this can last for a couple of days. So I think I mess it up and I no I will not pass now but when I ask for a review can I use these points or not. And does anyone know how long it takes for a review has I applied for PIP at the end of February so taking a little longer than I thought.

It sounds as though they may have realised your previous answers were just relating to dyslexia and not migraines so gave you the opportunity to speak about that after when they asked again.

Thanks. When I did the assessment, I got a bit confused but I tried not to let the person know, probably should have let them know, I was a bit confused on what they were asking. I am 100% sure I will not get enough points because I messed up the questions a bit, but hopefully on appeal to DWP or the Courts I will be able to get enough points and pass.

You mentioned you applied for the first time in Feb this year but then also mentioned a review. A review will only happen if you have an award in place.
If you haven't yet had the decision then this can take anything up to 12 weeks after the assessment report was returned. Once a decision is made you will be contacted.
I would try not to speculate anything at this stage and just wait for that decision.

Yes it the first time making the claim and I made it in February, sorry my dyslexia does not let me remember some stuff, I just mean the process between not passing the assessment and the appeal to court but I just can not remember what that part is called. I have had a txt saying they had my report but nothing since but like said I think I messed it up a bit because I said yes to the cooking and bath thing but just need someone to read the stuff to me but when we went on about my migraines, they asked if I can cook and take a bath when having a migraine and obviously not because my whole body goes like jelly and to a point where I can pass out, so I need to sleep and this can last 2-3 days but I think saying yes and than no will not look good so hopefully I can win on appeal instead.

If you need to challenge the decision it will be the Mandatory Reconsideration (MR) first. Once that decision is made if you're still not happy it's the Tribunal appeal but it's not a court and you won't be on trial.

Ok, thanks.
I am expecting to go to tribunal because I read that the mandatory reconsideration never works and they always go with the report from the assessment so I guessing my case will be going on until sometime next year, has I no everything is backlogged at the moment.

No not yet. Hopefully get it soon but with the backlog at the DWP and Royal mail only delivering letters twice a week, I guessing it may be a while.
Just annoyed with myself, because I wish prepared for the assessment but not sure it would have done me any good as with my dyslexia, my short term memory is not great especially when I am stressed so probably won't have help, the only way it would have done is if I could have took notes in and I sure you can not do that. Just wondering when i do get to send my mandatory reconsideration in does anyone no the timeframe on how long the DWP will take.

Ah the way you were talking i thought you may have received a copy already. In that case please try not to speculate, we’ve had many members that think the assessment didn’t go well and go onto be awarded.

Thanks, I think it just because I got so confused between them asking the questions about how my dyslexia effects me and than asking the same questions about how my migraines effect me so I think I may have messed it up a bit.
Thank you for the reply on the timeframe, it gives me a bit of idea on how long it may take, if I not lucky and have to go down the MR route.

I had a txt this morning, saying they have not yet made a decision on my claim, not sure if that is a bad thing or a good thing.

I call PIP helpline today and they said that my claim has now been past to a case manager but I also had a letter saying that they have all the information needed so after 30 weeks off waiting, I am hoping that I get a decision soon, like I put before I am not to hopeful of passing, so I am resigned to having to make a MR but I would like this to be in done and have a answer back from them before Xmas 🤞

It's usually sent to a case manager/decision maker once the report is returned. So it's perfectly normal for this to happen. A decision can take up to 12 weeks after the report was returned.
Please try to concentrate on something else while you wait.

Thanks, I am trying, I started back university this week and it is my final year so I got something to keep me kind off occupied. It just annoying, that seeing most people on here who got the "not yet made a decision" txt, get another txt within a couple of days about there claim been awards or saying a decision as been made. I no I not confident that I passed but now I just what to no what is going on so I can go on with next part.

So had the report today, I not happy at all, she basically did not listen to anything I said. She gave me no point of everything, even though I said I can not cook or have a bath when I have a full blown migraine and when I have a mild one, I have to be watch to make sure everything is ok and I have migraine nearly ever day. And she even scored me no points for reading and writing I am fully diagnosed dyslexic, I can not read or spell, I have to rely on other people to read and spell for me or use specific programmes on my laptop and phone to spell and read for me. Not happy.

Hey @jo1984, I'm sorry the report is like that. I and many other's have had a very similar experience. There is the appeals process though, which you can start with now. While you can ring or write in your Mandatory Reconsideration (MR) it is recommended you write in your MR as that way you know exactly what has been put into the system. You don't know if the person on the phone is putting it in as you say it or is abbreviating it. Do you have anyone who can help you type or write out the MR letter?

The same page also explains the rest of the appeals process if the MR does not succeed. I will warn you, only a small percentage, around 10-15, of MRs succeed. However, around 70% or more of tribunal appeals succeed. I know this report is upsetting, but you still have these two steps to properly get across how your conditions affect you.

Thanks @Jimm_Scope, it just very annoying and very stressful. I get more migraines when I stressed so not good for my migraine. I no it is very low percentage on MR but I no you have to do this before you can appeal to a tribunal court. And I no there is a way better chance of passing at the tribunal court so hopefully I can get my appeal in before Christmas.
