UC TP EROSION DUE TO LCWRA & CARERS ELEMENT

Hi everyone ,

I hope someone here has some knowledge about how UC Transition protection erosion works please.
I am concerned I will lose my tp. I recently migrated 18/8. single person , child element , disabled child element , carers element , housing element , and TP £364.33. On making my new uc claim I dotted the i’s crossed the t’s and answered the questions about my own health too. I migrated from TC and IS with disability elements added due to my own disabilities. Not sure if that makes any difference to my question.
Provided fit notes from 18/8 (same date as start of uc migration), without any breaks. I’ve just been awarded LCWRA. Now I’m concerned that I am also going to be down by around £200 a month due to the possibility of LCWRA eroding my tp completely and carers element being taken away. Or is TP eroded by the difference between LCWRA and carers element ? Are my calculations correct ? If they are correct then it seems awfully unfair that I would be penalised for being awarded LCWRA.Thank you in advance for any advice 🙏🏽

    Unfortunately, the TP will erode completely due to the £416.19/month LCWRA element when it's included. They will also remove the carers element because the same person can't receive both elements at the same time.

    Your waiting period for the LCWRA element will be Aug to Nov.. LCWRA starts from 18th Nov to 17th Dec and first payment will be 24th December.

    There's an Upper Tribunal hearing regarding this on 30th October and first this reason I'd advise you to request the MR and then Tribunal once the LCWRA element has been included.

    I feared as much poppy. I feel totally shafted by them. Considering none of my circumstances have changed. ie I have been disabled and unable to work for 15 years due to my health condition but have been a carer for my son for the same amount of time.

    I don’t suppose you know where I can find the outcome of that tribunal when happens please ?
