Hi, my name is Schnauzermum! Will a fit note get my son out of attending appointments and courses?
Hi everyone.
I really need advice. My son is on universal credit LWC plus PIP. Since May this year he has been called in for monthly appointments at the jobcentre. I have always been with him as he cannot go out by himself. These appointments give him a lot of anxiety and he really is struggling with worry over them. The latest appointment has put him on a training course. This is impossible as he can't do things by himself and I've been told I can't go with him. Can a fit note get him out of these appointments and courses? Before he was moved to universal credit he never had to do these things.

Hi,
As he has LCW rather than LCWRA then he will be expected to make some effort towards working. His work coach has the discretion to decide how much he can do and should be taking his health conditions into consideration.
Was he in the WRAG group for ESA before moving to UC? If he was in the Support Group then there has been an error during the migration, as he should have gone straight to the LCWRA group if so.

Heya @Schnauzermum and welcome to the community. 😊
That sounds like a bit of a pickle. Can I just check, did you mean your son was found to have Limited Capability to Work? If so, then he will still be expected to take part in training courses to get them ready to look for work, but they wont be expected to actually look for jobs. It's only if they are granted LCWRA that they'd not have to take part in courses.
You can add a note on his UC journal and ask for things to be done via the phone as a reasonable adjustment if that be of any would help?Just to ask, was he previously in the WRAG group when he was claiming ESA?

Hi, thanks for replying. He was in the ESA support group before changing to universal credit. I have asked him before if he would like to appeal but he was too scared to (and I could only do it for him with his permission).

Hi,
Thank you for replying. He was in the support group before changing to universal credit.

Has he had a work capability assessment since claiming UC?
If not, are you sure he was in the Support Group when he claimed ESA? Was he claiming ESA when he moved to UC?Sorry for all the questions just need some extra information to be able to advise you correctly.

Hey folks, just to let you know I've merged the two discussions just so there's less confusion. Hope that's ok. 😊

Thank you Albus, I was trying to figure out how to delete one of the discussions.

Dose your son have a support worker/carer/PA that can help him as you wouldn't be able to support him if he went for a job interview.

Haha, it's no problem at all, hopefully we can get to the bottom of this situation for you now. 😊

I asked some questions but with the emerging of the 2 threads I don’t know if you seen them. They are here.

They do not need to look for work.

No wca since changing to universal credit. He was definitely in the support group and was claiming esa at the time of changing to universal credit. We only knew about LCW when I asked at his appointment in May. I would like to try and get him into the other group asap. In the meantime I’m concerned he will lose any support because he’s unable to do the tasks he has been given.

My mistake I wasn't sure because I thought if you had to go to the job centre it meant that he had to be looking for work I thought you could only ESA if you are looking for work.

@Schnauzermum thank you! As he was in the Support Group then his UC should include the LCWRA element. Are you able to check his journal or ask him if that’s included please?
When you have LCWRA you have no commitments, which means no appointments of any kind and no courses. (Unless you want to attend the courses)

Those that have limited capability for work (LCW) may have to attend work focused interviews. Same applies to those in the Work Related Activity Group for ESA.
They do not have to look for work.0 -
oh ok I understand now

I’m not sure where he would find the information. He’s really stressed out, the Dr has given him a fit note but I can now see that it is useless. He can’t be with strangers on his own. He needs me to advocate for him, sometimes to even speak on his behalf.

Might becoming an appointee for him be a solution?
If you are able to view his UC account, each payment statement has the elements listed for the claim.
