edited November 2024 in Universal Credit (UC)

Hi, I apply for UC for myself and in behalf of my husband as he is disabled. We have two kids 15 and 19 years old but they will be turning 16 and 20 in next January. As a couple me and my husband have been on ESA, HB, council tax reduction and child benefit and also child tax credit for youngest child. My oldest child is on university and stopped any benefit 1 year ago 5 months before her 19 birthday ( I was not sure if that was ok). I app. for UC on 23.10.24 and didn’t put my daughter as someone non dependent who lives with us in the house. She use to work 6-8 hours a week . My husband is 65 and I am 57 and I care about him but I never was asking for Care Allowance but now while applying for UC I told them that I care about my hubby. Do to my health, mental and physical and as I don’t drive , our daughter drives us everywhere we’ve need. Our house is council property and has 3 bedrooms ( one of it is box bedroom and as it is downstairs it has been in use of my husband as he can’t go upstairs). Regarding our HB we get messages in our each journal that we will get £363,40 as H.Element and will be paid to our landlord but our HB till now was £101.60 per week, so as they said all over this we have to pay.Just to tell that my husband is on PIP highest daily and mobility rate. We still don’t know how much of UC wi will get ( it’s going to be on 30 November). So if anyone can give me any better advice regarding all this information please , regarding our daughter and do I need to separately apply for Care Allowance, thank you

    Good morning @MisterMaster

I just want to make sure I’ve understood your message correctly. Could you confirm whether your husband receives the Daily Living component of PIP? Also, does your eldest child live with you full-time?

Towards the end of their comment they said this.. Just to tell that my husband is on PIP highest daily and mobility rate.

Ah, thank you @poppy123456. I had spotted that but got confused with the sentence before, so just wanted to clarify.

@MisterMaster, if you submitted your UC claim on 23rd October 2024, your first statement likely won't be ready yet. Where did you get the housing figure of £363.40 from?

If there’s a difference in your housing amount, I think the issue could be related to how you've reported your eldest daughter. If she’s living with you full-time and you haven't listed her as a non-dependant in your household, you may only be eligible for a 2-bedroom rate. This could mean that if you're renting from a council or housing association, you might be subject to the bedroom tax. If you're renting privately, you could be receiving the 2-bedroom Local Housing Allowance (LHA) instead of the 3-bedroom rate.

If you could confirm whether your eldest daughter lives with you full-time, we can try to help you understand your rent element more clearly.

Thank you @Morgan_Scope and @poppy123456 for your help. Yes my oldest daughter lives with us but as her aunt lives close to her university, she used to live in aunties house sometime ( doesn’t pay any rent there). So my question to you is… what is best for us, to put her living in with us or not? Also my question was about CA , do I need to apply for it ( I told UC that I care for my husband) or what? You asked me about rent pay amount, from whom I got it from…I got a message from UC in my journal that this amount of money £363.40 they will pay directly to my landlord, and if I’m not happy with that I can complain as send them message in journal.

@MisterMaster, if you’ve reported being a carer to Universal Credit (UC), you should receive the carer element in your first payment. You do not need to claim Carer’s Allowance alongside UC, although some people choose to do so. If you do claim Carer’s Allowance along with UC, please be aware that it will be deducted in full from your UC payment, as it is considered an overlapping benefit.

As your husband receives PIP, there will be no deduction to your housing element for your 19-year-old daughter living with you. If she is living with you full time you will need to report her as a non-dependant living with you to UC. You should not have any deductions as your husband receives Daily Living PIP, and as I mentioned in an earlier comment, it may increase your housing element.
