Did you have a review after telling them of a change of circumstances? if not then it will be at the decision makers discretion if they backdate or not. If you didn't inform them then I would asap, my review came in and I was about to tell them of a change of circumstances but didn't bother because I had the forms there ……. no backpay the higher award was from the date the decision was made. I do wish I'd telephoned them to say things had changed even though my review was in progress

My review is because my pip was coming to an end.but I have rung them to update that I've now been diagnosed with COPD ?

I would ring again and make sure they are aware of a change of circumstances rather than just a new diagnosis. Mine was also a review due to the length of award so was due around the same time I had a change, I didn't inform them because I thought it wouldn't matter as I already had the forms.

    I’m

Gong through exactly the same thing now.((

I few totally swindled out of 18 months at higher rate.((

Can I reappeal or make a complaint

Do I still need to change my circumstances even though I have new award from last Friday

It should b explained to us better! Their way of not paying the back pay we are clearly entitled to!!!

I’ve even spoken to them when they said I had been awarded and he said it will b decided if im entitled to any back pay!!

Didn’t say I need to change circumstances!!!!

This is because it depends who starts the review. If DWP start the review because you were coming to the end of your old claim, then they aren't really expecting anything to have changed.

But if you start the review by putting in a change of circumstances, you are are expecting a change.

In my case, I did still get backpay from the normal review, but it is down to the decision makers discretion if you didn't trigger the review yourself.

In my case, my review papers arrived roughly a year before the end of the award. By the time they arrived I had a week to get them returned or my payments would be stopped, obviously I filled them in and sent back straight away …….. like many not aware that it would take another year to actually finish the review and believing as they had the papers they would see that my circumstances had recently changed before filling them in. Didn't have a clue that I should have still telephoned as they already had my papers with my new circumstances, I think lots of people probably don't realise that backpay depends on who gets your paperwork and awards you. It really shouldn't be a lottery, either everyone should get it or no one.

    it’s ridiculous

You could do a mandatory reconsideration I suppose as your decision was so recent. I was afraid that someone else would reduce the award rather than just look at the backpay element so didn't.

Hey @helenzx6r, an Mandatory Reconsideration (MR) is the first step appealing the decision you are unhappy with. If you'd like to read a bit more about the process see our advice page on appealing benefits decisions here: Appealing a benefits decision | Disability charity Scope UK

We usually recommend you write, or type, up a letter and send it to them. That way you know exactly what is being given and said to the decision maker, while doing it over the phone you cannot guarantee the person on the phone is putting down exactly what you say. They may abbreviate or shorten and miss out important details.
