    Just quick help I was in same issue it’s been resolved 3 months later


    they have backdated the amount for career element


    just state on journal under payments it’s quick way get message across as it goes to case manager


    me an my partner both in lwrca an they said wasn’t entitled to careers element


    corrected them both are in lwrca then the other can claim career element if they are on pip benefit award


    just takes time but please put your mesage under payment


    an call the Uc help line an they will ask case manager contact you in 24 hours

    thank you so much @bi786 for your response it has given me even more confidence that this will be awarded by knowing you managed to successfully claim carers also. I have made sure i always write in my journal now via the payments section so as not to get a generic response from call centre staff. Once i receive a Decision i will update you all and as poppy stated if it is refused i will request MR XX FINGERS CROSSED they dont try to make it difficult for us anymore

    FANTASTIC NEWS! today my statement has been released by UC and they have awarded both LCWRA for myself and carers element for my partner! Thank you so much for the help and advice! The only thing we need to wait for now is the decision on backdating payments and how far back they are willing to backdate the award for. I will keep you posted xxxxx

    hi @poppy123456 now that they have awarded us the carers element a note in my journal asks which date i would like the decision maker to consider back payments from and advises me to report the change from that date in the journal !!! My pip started back on 29th Nov 2021, is this too far back or should i continue and the report the change that my partner started caring for me from that date ? Surely they wont be likely to back date that far???

    hey guys I have an update on this whole situation i was wondering if someone could confirm the decision for me as you were so helpful before and it was only because of your fantastic advice i pressed for this with uc. - I requested the decision maker to backdate our carers element of uc to Nov 2021 when my pip was awarded and have today received this letter!!!! I think it means they are going to backdate but i just cant be sure, and also any idea how much this will be!

    We had a similar situation. Couldn't claim carers allowence or carer element as I didn't have daily pip till I went to tribunal. Which was concluded with full enhanced for both. Contacted uc via journal to say as such and then the said that we should have reported this back in July 23, which we couldn't do change or circumstance till my wife actually became my full time carer. Went to decision maker and agreed for reason why late response. We we received full backpayment for the whole period for the carer element from start of my initial pip award. It was a stressful time as we were worried they would sanction us for not declaring my wife's change from lcwra to carer but was all sorted in the end. The letter you posted above was exactly the same as we got and we got the full backpayment of £2880 with our next UC payment, and now the paperwork is correct with my wife receiving carer allowance and the £198 additional carer element going forward.

    We didn't pursue the backdate for carers allowance as this is taken off the total of UC so they would have paid us a lump sum, then just taken it back off us as an overpayment for 14 months. OK they have limits to paying back but it would be just mean we would receive less per week and would send us over the £6000 threshold.

    thank you so much for confirming the same letter for you meant it was agreed! Like you I was extremely anxious about the whole situation, and UC gave us wrong advice and dismissed us on several occasions when we enquired about the carers element, and told us we were not entitled, if itv wasn’t for poppy giving me such wonderful advice on this brilliant forum i would never have argued my case to even get the carers element going forward let alone request it be backdated to Nov 2021 (if that is what it means- fingers crossed it does)

    we actually got the ca back payment last week but just for three months so luckily i have kept this aside so as not to get in debt trying to pay it back monthly, but now i hope they will just deduct the ca overpayment from the CE underpayment and we will be equal again!

    With ours they adjusted every payment award right back from the original claim in July 23, which is where the amount came from as an underpayment. Only issue we have and still have is the council tax discount, because the uc didn't apply the changes fast the council saw it as extra income of £500ish and we've had to pay more council tax than we did before I was ill but it will all settle down eventually.

    The letter says UC have agreed to apply the change from the date it happened, November 2021.

    From what I read 3 months is the most they can backdate for ca but we couldn't do with confusing matters anymore than they were.

    thankyou so much @Kimmy87 - i am totally gobsmacked, they have also just now put a letter on my account stating the amount and that it will be in mu account within 3 days! Honestly if wasnt for this AMAZING community I would never have gone ahead and challenged the decision, I am so grateful ☺️

    poppy you were right, THANKYOU SO SO MUCH for your advice, not only have we been awarded carers element going forward we have also had it backdated 3 years to start on my pip award! While process took a little over a month, and without your advice and reassurance i would not of even known this was a possibility x i am eternally grateful to this fantastic forum and those in it xxx

    To me this letter says that they are indeed accepting your claim to backdate everything. Congratulations 😊 The payment will likely take some time to calculate, but when you get it you should treat yourself to something!

    thankyou Jimm_scope, they have this afternoon already adjusted all my statements and sent me confirmation of the amount which will be paid within 3 days! Im so happy and relieved xxx
