PIP Mandatory Reconsideration Unsuccessful

Hi All,
I have just received my letter, with the decision of my PIP Mandatory Reconsideration which was unsuccessful.
How should I prepare for my second tribunal, as I am going to appeal the decision.
All my medical records and other evidence, was submitted the first time my benefits were stopped and I went through the entire process the first time.

Hi, when you say second tribunal, do you mean you've done one before, or is this your first one?
MR's rarely change the outcome so having that refused doesn't mean you did anything wrong in it.
Preparing for tribunal is pretty much the same as the MR. Just making sure that you know where you should be scoring points and that you have the evidence to prove why you are unable to complete the descriptor task reliably for those points.

It's the second time my pip has stopped so going through the same process from start to finish again.

Ok, that's frustrating but at least you've got the experience from the previous one this time.

My MR decision letter was added 28th December 2024, which is a month on next Tuesday.
I phoned the citizens advice today and it will take 15 days to see an adviser.
How do I ask for an extension on the decision letter?

Hi @Adam____F really sorry but I haven't had any personal experience with this. I have located a website that might be helpful. It's one they reference on other charity websites too as a good place for tribunal preparation. It's Turn2us PIP Helper. There's also Citizen's advice that may have some experience with this - Challenging a PIP decision - mandatory reconsideration - Citizens Advice. It might be worth arranging an appointment with them.

You don't need to ask for extra time to request the Tribunal. As you're outside of the 1 month timeframe you will need to give a reason why you didn't request it within the first month. You have 13 months to request it. It's highly unlikely that HMCTS would refuse a late appeal request.

So the fact that the letter date is 28th December 2024.
Plus, I received the letter on the 20th January, so a tight timescale to respond in a suitable time frame is a good excuse for been late in appealing?

Yes absolutely! As I advised, it's highly unlikely that HMCTS will refuse a late appeal anyway.
