Please advise me about PIP

I wonder if you could advise me?!
My daughter receives HRC and HRM from PIP, UC and limited capability for work component. I work full time but have an on going back injury, 4 bulging discs that I received injections for in 2021. I currently have a flare up of my back and can’t walk, sit or lay without discomfort. (I had a biking accident during lockdown). My question is can I claim PIP in my own right?
Please advise me as I am totally confused with this.
Thanks Leonie

Your daughters PIP will not make any difference to any possible entitlement you may have. Whether you're entitled will totally depend on exactly how your conditions affect you as it's not awarded based on any diagnosis.Usually flare ups of such conditions don't last that long so you need to be aware of the 9 month rule going forward for any possible PIP claim, as you need to expect that difficultly to last at least a further 9 months.People do work and claim PIP but if the work you do contradicts the reasons why you're claiming PIP then it can go against you.It would be worth having a read of this so at least you'll have some idea of the criteria involved. https://www.gov.uk/government/publications/personal-independence-payment-assessment-guide-for-assessment-providers/pip-assessment-guide-part-2-the-assessment-criteriaA claim could potential take several months, sometimes longer.

Thank you Poppy123456.
I will look into claiming PIP for myself.
Basically, as it stands at the moment, I can not work. I am employed by a school but the situation with my back is not allowing me to fulfil my employment.Am I able to claim carers allowance for my daughter?
Im trying to weigh up if it is possible for me to claim PIP for my back and claim carers for my daughter. Is this possible?0 -
You can claim carers allowance for looking after your daughter. However, if you do return to work then you need to be aware of the earnings limit per week, which is £132 after deductions. Lots of people are carers and claim PIP as well. Are you currently claiming SSP from your employer? Have you checked entitlement to UC for yourself? If you live with a partner you'll need to claim as a couple. If you have savings/capital of more than £16,000 you're excluded from claiming.0

Thanks Poppy you are so knowledgeable about this stuff.I work full time, so can’t claim carers, but if I was to claim PIP for myself and carers that would fill a hole.We can’t claim UC as my husband also works full time.Thank you for your advice!0

Although you're employed you said you weren't working at the moment. Being employed doesn't affect any carers allowance claim, it's earnings that affect it.Are you claiming SSP? If so and you can't return to work once this has ended then you can look at claiming New style ESA. You'll need your SSP1 form and a fit note to claim it. You'll need to have paid the correct amount of NI contributions in tax years 2020/21 - 2021/22. The assessment process for this is the same as your daughter had for UC but New style ESA isn't means tested.0
