good evening everyone. just want some advice please. so I am getting low rate mobility and enhanced care. mobility should be enhanced , in the next few months I should be getting my forms through as its coming up to 4 years ( I think ). My condition has changed and I should be on full points. Is it worth mentioning it now or when the forms come ? As I have a strong case and if they didn't award it I will take it to court.

When you receive your review forms you need to tell them about all your conditions and how they affect you. You need to treat the review as a new claim claim. Any evidence you have should be sent with the forms to support your claim. Do be aware that for reviews there are huge backlogs so you could be waiting quite some time for a decision once you return the form. Most people have assessments too so it's likely you will need one of those. Most are now done by telephone, some are face to face at an assessment centre and some also video call.

@poppy123456 many thanks for your reply. much appreciated. well my previous claims have been paper based. as a face 2 face they won't see me as I'm aggressive due to my condition. and wouldn't take part in a phone call or video so in my case it will be paper based. but then again if they have enough information they don't have to do any of the above you said. I will treat it like a new claim. and if they don't accept it then I will apply to the court and win. as I no what I am entitled to. based on the descriptors ect ect.0

Please also bear in mind that just because your health condition has changed this doesn't automatically entitle you to Enhanced mobility. Whether you're entitled to it will depend on exactly how your conditions affect you.

@poppy123456 it does as the descriptors says it does as that's where I am getting the points. like I said if I don't get it I go to court and win. Job done. ✅ So many settle for what ever where I won't be doing. as I no what I should be on as it affects me.0

In a previous thread here https://forum.scope.org.uk/discussion/97773/i-think-im-entitled-to-lower-rate-mobility-what-should-i-do#latest back in November 2022 you said your award was just Enhanced daily living and no mobility. Now you say you have Standard mobility as well, did you report any changes since November 2022 and had a decision on that already? If you did then are you sure that you're due a review already? I'm assuming you must have because your award seems to be different now to what it was back in November.I'd advise you to check your award length to make sure because it seems odd that you're due a review so quickly.
