There's no reason not to award you this if your wife is claiming either daily living PIP, DLA mid/high rate care or ADP daily living. If the LCWRA element is for your wife then you claim the carers element, it's as simple as that. You need to request the Mandatory Reconsideration on the decision not to award you carers element. You can do this on your journal and tell them you disagree with the decision and because the LCWRA element is paid for your wife then you can claim carers element. (Assuming no one else already claims either this or carers allowance for looking after your wife)

Put the request under "payments."

We only look after each other have no one else. Will do this now and see what happens but I do think they will still say no. Will this below be ok to send them i'm not good with stuff like this.
I request a Mandatory Reconsideration on the decision not to award me carers element. i disagree with the decision because the LCWRA element is paid for my wife then i can claim carers element. i have mentioned all this in my journal but had no reply.0 -
That's fine. There's simply no reason at all why they are refusing your claim for carers element.

Although you have both been found to have LCWRA only one of you can receive the extra money for this. Therefore the other receives the carers element. You can refer them to this. https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1015113/admf6.pdfJoint claimants each entitled
F6036 Where each of a joint claim couple qualifies for a different element, either
1. the carer element or
2. the LCWRA element
then both of those elements may be included in the award.
