How long do you think I'll be waiting now, if the legal officer is looking at the dwp response they said that next step is my claim being made 'ready to list" for a judge and everyone to make a decision but they also said a decision can be made anytime its just so stressful waiting

There are no timescales. I'm still very shocked to hear HMCTS refused a telephone hearing. This is not what they usually do because usually they prefer you to tell them in your own words exactly how you're affected  by your conditions.

Did they give you a reason why this was refused?

@poppy123456 well I told them a while back I still want a paper hearing so that's probably why

@poppy123456 I've emailed them again to see if I can get a telephone hearing

Am I more likely to win with a telephone hearing?

That chance of a decision in your favour with a telephone hearing is 70%+. For paper based it's extremely low 5-8%.

@poppy123456 ah that's good hopefully they reply to my email if not ill have to call them. I'll probably end up calling them because my anxiety is bad and I worry and think about things to much.

That’s great they are changing to telephone, I thought they would have because they don’t usually refuse such a request. Yes, you will receive a date/time in the post but it could be several months.

I wouldn't worry too much. There's either an issue with the tracker at the moment (which does sometimes happen) or they are just updating it because you've now asked for a telephone hearing and not paper based.
