Pip change of circumstances

Hi, I have been getting the standard rate of PIP (daily living) since last Sept. I have a problem with my left ankle and arthritis in both knees. Very recently, my right knee has deteriorated severly and I now need a walking aid and take regular doses of Naproxen for the constant pain. I am also undergoing regular physiotherapy too. I was thinking of notifying DWP of a 'change of circumstance' but am worried that they will stop my PIP. Should I go for it or stay as I am? Any advice would be welcome. Thank you.0

@M_1967 yeah you should totally put in a change of circumstances as your Condition is getting worse but that's only if it effects your daily living ect. In my opinion anyway they might keep your award the same like they did with me but its different for everyone but then just appeal0

@M_1967 no they don't stop payments the only time they will stop a payment is if they make a decision for you not to have PIP anymore but that's rare. The only time they will do that is if they take points of you. I'll suggest that you seek professional advice from citizens advice or someone that deals with help, with PIP claims @poppy123456 might help you send a link to that0

A worsening of condition doesn't automatically entitle anyone to more points for a higher award.M_1967 said:Hi, I have been getting the standard rate of PIP (daily living) since last Sept. When reporting changes as you know you're sent more forms to fill in and return with all your information. Another assessment is most likely because most people have them. You also need to have had experienced the changes for at least 3 months and expect them to last at least a further 9 months.Once a decision is made your award could either stay the same, be increased/decreased or even stopped completely. You can get some expert advice from an agency near you. This link will help with that. https://advicelocal.uk/welfare-benefits

@WhatThe hi I'm getting a bad gateway message when trying to track my appeal0
-
It sounds like DWP muddled the process somewhere (like it wasn't hard enough) and didn't send you the papers but has now
HMCTS should not be involved yet so that message sounds reassuring

@WhatThe yeah it dos. I did speak to HMCTS online yesterday and they said that it can take up to 24 weeks to make a decision so someone else obviously lied saying 30 days lol. But they said that they was having some technical problems yesterday that's why I couldn't log into my appeal, but they confirmed that they still have my appeal and there waiting for my appeal to be allocated a hearing date0
-
Hi so I've received an email from HMCTS today saying "Thank you for your email. At the moment, your case with a legal officer who will review the DWP response, Once this has been done it should be made "Ready To List" or waiting for a Judge to make a decision"
Can the legal officer find an error in law and make a decision there and then if they find something untrue or anything like that?0 -
Errors in law only apply once the Tribunal make a decision.Have they agreed to a telephone hearing?0
-
@poppy123456 ah OK and no paper hearing0
-
Are you saying they refused a telephone hearing? If so then I’m very shocked! They usually prefer to hear from you in your own words.0
