Won my child DLA tribunal

For the first time in February 2022 I applied for child DLA for my son DLA rejected my DLA claim form then rejected my claim again at the DLA MR stage, so I went to tribunal where a Judge, Doctor, Disability Person, and a DWP representative was present, it was a frightening and anxious experience but I am glad I have won 5th June 2023 and I call DLA today and they said that they received my tribunal decision and it’s been given to there decision maker in the appeal team.

My questions I wanted to ask is 

1. Do the Dwp appeal against tribunal decisions?

2. What is the process now that the decision maker has my tribunal decision? 

3.How long does it take to get backdated payment?

    Great news.
    1/ No, it's rare. They sometimes request the statement of reasons but rarely appeal it. If they request this it doesn't mean they are appealing.

    2/ you just need to wait for the award to be put into payment.

    3/ anything up to about 8 weeks.

    Hi,

    Ibe applied for dla for my boy, it got denide, so I've done the mandatory reconsideration still denied, so have applied for an appeal, he has a diagnosis even the pedestrian has request a ehcp for the nursery he is in to push through, what should i expect, im not very confident and hate asking for help, I've lost my job and his nursery have put in a claim for extra funding extra for him, which now has been a waste as i can't afford to take him to nursery through waiting on bennifits not working and my boy needing extra support, is anyone else out there in a similar position, thanks Michelle xx

    Hi,

    I'm afraid I can't offer any experience with a child DLA tribunal but just wondered if you have you applied for out-of-work benefits yourself such as Universal Credit?

    That should be paid 5 weeks after you first apply for it and you can request a budgeting loan while waiting for that if you need to. (Just remember it is a loan and does need to be paid back slowly from future payments)

    We got universal credit, but wasn't the right amount my employer release my wage amount to be more than we got so have to wait till the next payment, it really is a hard place to be after holding a full time job supporting my famy to having nothing

    Oh I see, I'm sorry to hear that. Hopefully that gets sorted soon as it could take a while before you get to the DLA tribunal.
