If her ESA included any contribution based ESA it should continue but any income based ESA for her would stop. If her ESA was completely income based I would not expect her to have got a P45. The receipt of a P45 suggests contribution based ESA (or new style style ESA)in which case it would not have stopped. She should clarify this and if necessary challenge the stopping of the ESA.

Your ESA will be recalculated as a couple. If she does receive any ESA it will be deducted from yours.

Your ESA as a couple will be less than you used to get as two individuals.

Can you confirm what sort of ESA you get and confirm if your partner gets any other benefits.

You can use a benefits calculator to see what your should get.

    Hello calcotti

MY partner is only on esa she been on it fir over 6 years I think it's income related allowence they said all would happen was I'd be the main claimant and she would be added on to mine I was thinking is this why they sent these letters but it says on the letter the law says we can't pay employment and support allowence it's odd I received a text Monday saying they received the ESa3 form and it would be actioned today no need to call then  we get these letters

As a said, it her ESA was fully income based I would not have expected her to get a P45 because income based ESA is not taxable. Contribution based ESA is taxable. Can you see the calculation page of her ESA award (although they are notoriously difficult to interpret).

I've got this year's award letter but it jusy says esa employment and support allowence award she gets about 148 per week that's all it says on there  I just read the letter again and it says Sgt the top we are writing to tell u that the contributor element of esa cam count has taxable income then it's got fur the period  from dates so and so was taxable would that mean it's contribution based do u  think

You've posted a photo of the wrong page because it doesn't indicated anything on that letter other than her ESA has ended. As calcotti said, we will need the page with the breakdown of what her ESA award is made up of.

You should have covered all her personal information such as name and NI number. I can see both of those clearly on the bottom photo. You can edit it and remove the picture within 59 minutes of posting the comment.

As she was entitled to the christmas bonus then at least part of it was contributions based. The bonus isn't paid when claiming all Income Related.

You're not useless at all, it's easily done. Yes, you removed it. As part of it was contributions based i wouldn't expect that to end (£129.50/week) but it will be deducted in full from your ESA calculation. She needs to ring ESA to speak to them to ask why it ended.

This is why I'm wondering if cayse I was adding her o to mine I was becoming the main claimant I'm praying they sent all this cause she is not the priority claiment my claim become a claim has a family if that makes sense however iv not had a letter saying mines gone up or she's added onto it or nothing

As advised because her ESA was part contributions based then it should not have stopped completely. They will then use that amount in the calculation for your ESA. You will be the main claimant of your claim and you will receive extra money for her but overall you will receive less money than you were receiving as single people. It may take a few weeks to recalculate your ESA.

She does need to ring them to ask why her ESA stopped completely.

Who told you that none of this would happen? No one can force anyone to live together, that has to be both of your decisions.

Before you became a couple then its correct that it wouldn't have needed to be reported. Once you started living together as a couple then reporting the changes was correct. You can't live together as a couple and continue with your single ESA claims.
