Hello kerry77You said in June that you had a date for your appeal today and you are getting support from your local welfare agency. Use the advice you have been given by your welfare agency.Have a glass of water with you and just be yourself and answer any questions they ask you in detail. Remember the tribunal are interested in your condition and the problems you were having when you made the claim and not the problems you are having now.Good luck with your tribunal.Nasturtium0

Yes my welfare rights worker wrote a letter of support but I haven’t spoken to them since and they said they would be in touch to help prepare me but unfortunately he is on leave that’s why I asked in here
My daughter has agreed to sit with me
thank you hopefully it will go in my favour1 -
You may not have a decision today but don’t be too alarmed if this happens. Sometimes they can’t make a decision on the day but you will receive the decision letter in the post within a few days. It doesn’t mean you weren’t successful if this happens.
Good luck.0 -

Good luck today @kerry77. My top tip would be to take your time answering questions. I know I rush when I'm feeling anxious and then forget things I've wanted to say, so take your time. If you have notes written down this can help too.
Best of luck and please let us know how you get on.0 -
I won my appeal l was in such a anxious state and overwhelmed they gave me a break and in the break the primarily awarded me enhanced mobility and standard care but after the next questions about care they said it may be changed to enhanced and I will know within few days with the decision
can I just ask what happens next can the dwp appeal this ?3 -
Great news. You will be sent the decision letter from HMCTS within the next few days. They will also send the letter to DWP.It can take anything up to 8 weeks to receive any money owed and the same time to put your award into payment. Before they pay you they will contact you to ask if you've been in hospital or prison. Sometime after that they will pay what is owed and you'll receive the award notice (decision letter) from DWP.They have the same chance we do to appeal the decision. Before they can do this they will need to request the statement of reasons within 1 month of the date of the decision. Once they receive that they need to find the error in law before they can take it any further. They sometimes request it but rarely appeal it. If they request it, it doesn't mean they are appealing.1

Update on my pip
someone from dwp rang me today asking if I’d been in prison rehab ect and then told me that my payment would be in my bank with in 5 working days he then mentioned if I had any changes in care to ring them with well I received a diagnosis for complex ptsd so I rang and the automated payment line said I would be receiving a payment of 98.71 on 24 November but my claim is from October last year so I’m really confused about it as it mentioned debt recovery but I only owe less than 1000 to tax credits which I pay from my universal credit
has anyone else had this and could help me understand it
thanks0 -
Just to say I put the phone down and did not continue to speak to someone as the wait was so long0

They can take the money you owe from the money they owe you. This will be why it’s gone to debt management.Having a new diagnosis is not a change of circumstances that needs be reported. You need to be very careful reporting this. They could send you more forms to fill in and return and the whole process starts again.
You should get some expert advice before doing anything else. Reporting changes means you risk your current award ending. Once a decision is made your award could either stay the same, be increased, decreased or stop completely.0 -
Oh right thank you for that I will get advise first thank you
My daughter is ringing them to find out what it is I’m paying and how much cos my back pay for pip from October is much higher than any money I owe anyone and why a payment of less than 100 when I’ve been awarded enhanced for both and in November when we are only in august ? im just really confused 🫤0 -
If you have been awarded Enhanced for both then reporting changes for a worsening of f condition is pointless because you can be awarded anything higher, regardless of how many more points you can score. You shouldn’t take too much notice if the automated payment line because it very often gives incorrect information.
If you have questions about the money they owe then you will need to ring PIP to ask them. They are the only ones that can tell you what’s happening.0 -
My daughter spoke to them and said to just ignore the automated payment line because a payment hasn’t even been processed yet or an award letter generated so just to check my bank within next 5 working days
thanks for advice0
