It's perfectly normal for the MR decision not to change because only about 23% of them do at this stage.

You can now proceed to Tribunal. Do also be aware that they will not take into consideration any worsening of condition since the assessment took place. They will be looking to see if the original decision was correct at the time it made back in 2022.

    Thanks poppy,

i was was aware of that but the condition wasn’t worsening and how would they know if it was worsening or wasn’t if I never filled in the form I told assessor I was walking with a stick and I had to come down stairs in my bottom and have high incontinence but because I was taking otc meds and to many the doctors never gave me pain relief until after the assessment then put me in naproxen and tramadol but I still made the assessor aware and at the time was taking mirtaxapine for severe depression and anxiety but in decision it said no anxiety med or no pain relief so now they asking me to complete a pip how does ur disability affect u form because medications have changed but they are for the same conditions I don’t know wether to put my self though appeal or to do the form any advice greatly received thank you

To do the form you would need to report a change of health condition. You will then be sent more forms to fill out and return, which is not always a good idea. I know you never filled them out for this current award but you still have an award.

More forms will most likely mean another assessment and the whole process starts from the beginning again. Once a decision is made your award could either stay the same, be increased, decreased or stop completely. It's not always the best idea to report any changes.

Yes that’s what I have read on this site and I didn’t report any changes is that just to try and trip me up by asking for the form? I don’t know why they would ask me to fill out the form on a mandatory reconsideration as when I called yesterday afternoon to see if they had received another piece of evidence saying exactly why I disagreed  call centre agent said they hadn’t got anybody to look at it yet then it would be done within 8 weeks then 8 am this morning I received a text thank you for telling us your change of circumstances then I called and asked about decision on mr she said it was made yesterday I am so confused about the whole thing I really have no idea what to do

St that was 5pm yesterday aswell so unless they just copied and pasted this decision I doubt they had any time to look at let alone reconsider

When you requested the MR in June did you put that in writing or did you request it over the phone? If it was over the phone and then you sent extra evidence after that, they do not have to wait for that evidence to be sent they can make a decision at anytime. This is one of the reasons i don't usually advise people to request it over the phone.

When you rang yesterday if a decision had already been made at that time then they may not have been able to see it because it can take up to 24 hours for it to be visible on the system.

Did you report changes when you rang? Sorry but finding your timeline difficult to follow.

    So sorry for confusion

i requested by letter recorded delivery, 26/6 got few text will look at claim by 23/08
in my letter I told them about why I thought I should have my claim looked at again and sent medical assessments and letter from my son who cares for me along with the waiting times for pain teams and physio exercises I do

then after reading in-line here I realised I had done mr wrong as never answered why or what points I should have got just that I request mr because my situation is this

I then called up last week Wednesday to say I think I have done it wrong I will be sending the reasons per points made in the decision because they was incorrect, and if she could put a note on the system for me, she did that so she’s said, I sent it Wednesday next day delivery arrived Thursday

i called yesterday to make sure it’s had been received well just checking if it was in system and she said yes we have it’s today (Monday)
i asked her is there any update or manager looking at my case and she said no not yet

this morning (Tuesday) I received the text thank you for telling us about your change we have sent pip how ur disability affect u form please send back in two weeks

i called at 10:00 this morning regarding the text the lady said she doesn’t know why the text was sent but decision on mr was made yesterday and remains the same sdlr

When you rang yesterday as i advised it's likely the decision wasn't showing at that point. It was the end of June when you sent the MR request letter so yes a decision can be made anytime.

As i advised, it's not unusal for the MR decision not to change. You can now proceed to Tribunal.

Yes sure I understand that I will go to tribunal if need be but would have thought after asking them last week to wait they would have done so but I guess it was just easy way out but will wait for mr notice absolutely not going to let it get to me maybe I will request reconsideration of reconsideration lol as it was not done correctly clearly have evidence of wat meds’ I was on at the time so will inform them that I will go for appeal and see what they come back with

but thank u for ur advice poppy have a fab evening

The issue is that although you asked them to wait, they don't have to do that. A decision can be made at anytime once it's requested. Unfortunately, you can MR the MR but i'm sure you know that.

Especially when I was awarded without form in the first place for them to actually know what a change in my circumstances would be as it is all in decision that have walking stock knee brace etc but oh well fortunately I’m not one to dwell on things what will be will be
