DWP has responded to your UC Appeal.

I received a message saying that DWP had responded to my appeal and was just wondering how long it would take to receive it in the post?

    You will receive what's known as the "bundle" this will include every single thing you sent to support your claim, including the UC50 form, all extra evidence, the assessment period and DWP's response. DWP will of course oppose the appeal and ask HMCTS to dismiss the appeal, which is perfectly normal. If they thought you were entitled then you wouldn't be at appeal stage. Your appeal will not be dismissed.

    Is it normal that I don't have a UC50 form? They didn't give me one, and they just gave me 2 weeks notice for an assessment in June 2023.

    No, it's not normal. Are you 100% sure you didn't receive a form, even if it was quite sometime ago... as in before the first lockdown perhaps? You will know anyway because if you did return one (and forgot) as it will be included in the bundle.

    Oh, maybe. I remember receiving one in March 2020, but my assessment wasn't until June 2023. 
    Would they have used that one?

    Yes, very likely if you never had a decision before June 2023. Though, i do think it's unfair that they didn't contact you to ask if you have any additional information because it was 3 years that the form was returned. There were people that were sent a form just before lockdown (myself included) some of those never had a decision. Thankfully, i had a paper based decision for that one.

    Yeah exactly. I get that lockdown caused a backlog, but if they've used my form from 2020 3 years later, I'll be arguing that they should've sent a new form if they wanted to reassess me. A lot changes in 3 years.

    Yeah, that makes sense, I wouldn't really say it's changed, it's still the same condition. But I don't even remember what I wrote on the form in 2020. I had asked my work coach about it as soon as I got the letter about the assessment, and they said it wouldn't matter. I've been honest with them about my health. 

    I'll wait until I receive the bundle to see what they've included. Thanks for your help.
