2nd PIP claim refused ADHD & Autism, can I put a MR in for my first claim?

Finally posted my MR back yesterday & now I'm obsessivly looking at every MR response forum post on the internet
I really tried to put my points across according the the advice given on here & explain why I disagree with each decision on each descriptor using bullet points, describing in detail the cognitive problems & issues relating to each one & also a few real life examples but reading back on what I wrote there are a few errors with my spelling & words so I hope it makes sense & now I wish I had put more examples!
Does anyone have any similar experiences with MR for ADHD/Autism & also timescales they have experienced & what is the next stage talking it to tribunal if its refused again?
Also, receiving the text messages from DWP during the process makes me unbelievably anxious & I become obsessed with it all - so I was wondering if its worth calling to say please do not send texts?

The most likely outcome of the MR will be the decision doesn't change as only about 23% of them do in the claimants favour. Timescales are up to 12 weeks.PIP isn't awarded based on any diagnosis, so it's impossible to compare someone else to yourself. If the MR decision doesn't change then yes it's Tribunal as the next stage.1

Remember that another decision maker will look at everything again including your initial claim form & assessment. You have now added extra information with your MR, which is a good thing. Please don't worry about a few errors with your spelling, etc. as they will be used to these!You really have tried to take everything onboard, so all credit to you. No-one will write a perfect MR, but you have certainly tried to your utmost.It can take anywhere up to 12 weeks to get a decision, but obviously some get one earlier than this. Please take one step at a time, & don't be worrying about a tribunal, which hopefully may not even happen.I would agree that the texts you get just cause unneccessary anxiety for many members. If you are able to get them to stop sending out texts it would be good to know as it would likely help many others, but don't ring if that in itself would cause yourself any upset.Do please kindly let us all know when you get your MR decision. Hello, I literally just got the letter in the post just now, MR stayed the same no award sadly.
I don't think they could have even looked at my MR really to not award me out given me anymore points, & ridiculous copy & paste decision with no mention of anything in my MR & letter! I spent weeks compiling my MR & letter with a lot of addition info & real world examples.
So I will appeal online today.0 -
Sorry to hear about that outcome @AngMavAuDHD, MRs are rarely successful but a necessary step towards a tribunal which usually go much better.
Thank you for updating us, I'm sorry they rejected it despite all the time and effort you put into it. Hopefully at the tribunal you will finally get someone (not from the DWP) to actually listen to you.1 -
I'm so sorry, as I know you did put in so much effort with your MR. Remember all that you wrote in it will be seen by a tribunal which is a positive thing, so your time has not been wasted.

Thank you, so now I am about to appeal online, when U did my MR I write a letter & about 8-10 pages with all points I disagreed in & examples etc, what is the best way to write my appeal? Do I need to put everything I have from my MR in the box?

You don't need to go into the full details because you said you did that for the MR. Just give a brief reason why you disagree. DWP will send everything you sent to HMCTS and you will receive a copy of everything in the bundle.. eventually.

I feel like the decision has nothing to do with me & what I have written in my MR & is kind of telling me how the PIP descriptors work which I already know because I have put all my reasons etc in my MR.

Impossible to advise without knowing exactly what you wrote for the MR. I wouldn't take too much notice of what the reasons are for not awarding you PIP. You need to move on from that and concentrate on the next stage.

Hi all, just to update you, I appealed my PIP decision & DWP had until 2/2/24 to respond.
I hadn't heard anything until today when I received a text message from DWP at 11.45am saying they would call me at 12.15pm to talk about my recent appeal request.
I spoke to a really nice lady, I was quiet anxious but she assured me I had nothing to worry about, she wanted to check my details & then she said she was calling to make a lapsed appeal offer which I have accepted.
I am pleased I do not have to go to tribunal now & it feels like a weight has been lifted!

Thats really good news and a massive weight lifted I'm sure! I'm awaiting my Mr since beginning of Jan. I was told I'd hear march time. I'm claiming for the same reasons as you - adhd, autism, GAD, OCD , and mobility issues arthritis, disc disease and neurological problems. It's so stressful, and the wait is awful! I got citizens advice to help with my Mr as I am a huge procrastinator! Hopefully you got the enhanced rate, i know what a struggle this is. Well done for persevering and for sharing your experience, their is hope for me yet!0
