Hi, my name is karen19862! I am due a phone tribunal next week

I have been reading all your advice for a few months regarding pip
I am due a phone tribunal next week and looking at my bundle the last response was awful from the DWP.
Like they were talking about someone else!
0 points on application and 0 points on MR even though everything I told the assessor is there in black and white.
Tips or advice on keeping calm and not fluffing it.
I don't think I could attempt the upper tribunal.

Update
It says on the my account appeal is booked but with no time showing.
I've not had a letter or anything so do I assume this is an error on my account or do I still wait for the call on that day?0 -
Hey @karen19862, welcome to the community. Sorry nobody responded to you yesterday! I understand Tribunals can be quite stressful.
I'm not very knowledgeable about the tribunal letters, but it's very common they aren't timed exactly, so it's likely you will just have to await the call on the day.
Citizen's Advice has a page on attending tribunals remotely. The most important thing is that you're very clear to the judge about any support you need or if you need anything repeated. The whole point is to hear your experience, if you didn't fully understand a question you can ask them to repeat it until you do for example.
If you have any more questions I will try to answer them or find the answer for you, good luck with the tribunal.0 -
Thank you for the advice much appreciated. I don't understand why no letter and the time says at 0.00 hours . I am prepared as I will ever be but it's been 11 months a couple more won't make much difference.0

There was another member here recently that was expecting their Tribunal hearing at it said 0.00 hours but I can’t remember what the reason was. I think though that their hearing didn’t go ahead.I would advise you to contact HMCTS to ask them what your hearing time is, rather than wait around on the day thinking “Will you be called”For your Tribunal you should concentrate on the weakness in your evidence and not the strength of DWPs.As you’ve been reading threads here I’m hoping that you’ve done what is advised daily here and sent a couple of real world examples of exactly what happened the last time you attempted each descriptor that applies to you. Adding detailed information such as where you were, what exactly happened, did anyone see it and what the consequences were.0

Thank you I've sent details of each point I disagree with0

I'm still waiting all they keep saying is it's ready for listing.
Makes me feel I've no hope of winning my tribunal.knocked back 4 times now and got 0 points on application and 0 on MR each time
I really can't see an award after reading through what the dwp have written.0 -
Just had a pip tribunal that lasted 1.5 hours totally drained was the worst thing I've had to do and I've completely fluffed it

Hey @karen19862 I'm sorry to hear that. But congratulations for doing it, that's a big thing! Why do you think you've fluffed it? Definitely put the kettle on and have a cuppa after that.

I really don't think they believed me. I'm still shaking and totally exhausted 😩

Our brains have a horrible habit of making us think the worst, especially when we're under stress. I'm sure they'll let you know soon and there's been nothing to worry about. ☺️

I've looked online it's not closed as yet but my mind is going into overdrive. Some of the questions were quite brutal to be honest but I got through it. That's good for me x

I'm sorry to hear it wasn't a good experience for you. Many people report back saying the same thing and go on to have a decision in their favour. You should be able to see that decision online in a few hours.

I'm sorry to hear that your Tribunal wasn't successful. You can request the Statement of Reasons and Record of Proceedings from HMCTS within 1 month of the date of the decision. Once you receive those you'll need to find someone to take a look to see if the error in law can be found. If it can't then you can't proceed any further.
Or you can get some expert advice to check whether it's possible to score enough of points needed for an award. If it is then you can reapply but please be aware that you could have another refusal if you use the same evidence you previously used.

I got some points that's the main thing and I survived the grilling lol
If I applied again would these points be wiped out
0 -
Yes, the points will not be carried over to a new claim.

So is it worth asking for sor or just give it up as a bad job xx

You should really only do that if you think there was an error in law made. You can't just appeal it because you think the decision was wrong. I can't tell you if you should do that because I don't know anything about your case.
