PIP Review Denied

Hi,

My PIP review came up, I was on standard for both parts, tribunal previously awarded me 11 and 10 points, now the review has come around, awarding 1 and 0, so I guess I am magically cured!

The decision letter is dated 11th of April, but it came today, the 19th of April, so I lost a few days there, not that it matters, as it's no doubt going to go to tribunal, again.

I honestly just don't think I have the energy to go through 2+ years of waiting for an outcome again. It's almost as if the system is designed this way.

It's so exhausting, giving up is looking like a better option, I'll never have to worry again if I'm not here.

Sorry.

Please don’t give up the world is a better place with you in it. Plus, you will just let them win. You will just let the evil system win. Please keep fighting for your life and for what you are entitled for. I wish you all the best.

Thanks, I know, I've been through this once already, think I have a SCOPE account too, but forgotten all the details sadly.

When you filled out the form did you treat it as a new claim? Rather than just put no change, if there had been no changes in your conditions?

I can't remember but I think I just filled it out to say there was no change, and that I still wasn't able to do certain tasks because of how it effects me.

You must always fill out review forms like it's your first claim with all the details of how your disability affects you... assessors use the information in the form to guide the assessment and it ensures all the information is provided to get the proper award. Relying on the assessment itself isn't always enough since they don't always ask all the questions they need too, when my BF was reviewed they forgot to ask the mobility descriptors regarding going out accompanied, he had to bring it up himself, he could of easily lost his mobility award as a result.

Yeah, I made sure to cover everything with the assessor. The annoying thing is that the decision reason for the mobility part didn't take into account anxiety or depression.

None of it did, nor the use of aids for dyslexia, or pads for incontinence. They only gave a point for managing therapy, everything got ignored.

What I don't understand is that you put no change but you had to challenge your current award. Putting no change simply means there was no change since the last time DWP made their decision so if you were refused last time, why put no change?

I wasn't refused last time, I was awarded 11 Daily and 10 Mobility last time.

Yeah because I went through the process of going through MR then successful tribunal.

Again I'm pretty sure I still gave examples of how my conditions still effect me but haven't changed, I also went through it all with the phone assessment.

Your replies are just making me confused at this point, I have no idea what you ate getting at.

When I said refused with current award, I meant previous award as you've had a decision on your review.

I asked if you have filled out the form and just put no changes, rather than giving as much information as possible and not just put no change. Putting no change is never a good idea especially if you had to take it to Tribunal for the previous decision. The same could happen if you gave the same information for this review as you did for your previous claim.

Moving forward for the MR if you have the decision letter still from the Tribunal for the last claim then I'd advise you to send that too and make sure you point out that nothing has changed.

Okay, sorry, I am a little slow at understanding some things!

I have sent the Tribunal decision with my MR, as well as the GP letter that was used at my tribunal, which outlines everything.

Hopefully that will clear things up then, I didn't know they base it on last claim, not last tribunal.
