Appeal against educational placement- EHCP

Hi, new here. I have CP and ADHD and my 11 year old son also has CP, learning difficulties and (in my view) traits of ASD. Educated in mainstream primary school and from day one I’ve had to fight to get every bit of additional support for my son. I initiated an EHCP referral whilst my son was in the spring term of Year 4 (it took until the autumn term of Year 5). School were initially unsupportive of the referral until I contacted SENDIASS, then when the EHCP was granted the school suddenly got on board with the plan. I’ve been looking at possible mainstream secondary options (for September 2024), for my son since he was in Year 4. I have an older son (no SEN needs) so did consider his school but quickly reconsidered after several meetings with the SENDCo there, during which I was told that they would welcome my son because they ‘would have to’, but they said his EHCP was undeliverable and commented, ‘it’s not a magic wand’. I then visited SEN settings and found one in particular which I’m convinced can meet my son’s educational, physical, emotional and psychological needs. This school confirmed they can meet need and that my son can be offered a place. The LA have named the mainstream school on the EHCP, despite all of my concerns, and submissions by the SENDCo of the mainstream school. We have a tribunal date (was Jan 2025, but upon appeal it’s been brought forward to July 2024). I’ve submitted all of my evidence and case review form. Evidence includes confirmation from SENDCo in primary that my son will be vulnerable in a mainstream secondary without extensive support. My SENDIASS caseworker says the LA have a very weak case and expects it won’t come to tribunal stage before they back down. I am very impatient and anxious that time is running out for the LA to change their stance pre-tribunal. Any advice/ reassurance/ bluntly being told to have patience would be much appreciated!
