Moving in with partner, UC and lwcra

Hi, I have a real concern regarding my UC claim. My partner come out of prison on 22nd may and we made a claim for UC today. She isn't working and I'm on UC with lwcra. I got a code for linking our claim together but now my journal states that we will get the standard allowance but I will have to be reassessed for lwcra. I don't understand, is this right?

    When you report changes and use a linking code to join both claims together everything on your journal is cleared, this includes all statements and all journal entries.

    You do not need another work capability assessment. Before you reported changes did you keep a copy of the decision letter you received for the work capability assessment? If you did and they question the LCWRA element you will have proof that you've already been found to have this.

    When you joined both claims together your assessment periods and payment date should have remained the same, did this happen?

    Put a note onto your journal and tell them that you've linked a claim with your partner but you've already been found to have LCWRA. It may take them a couple of weeks to include that with the claim.

    Hi there Poppy, thanks for that I was getting in a right state about it! I don't have the decision letter anymore but they have the evidence surely if this, if not my bank statements would show I don't get the standard allowance alone. I hope they get it sorted quickly as this is a happy time for us, and it won't be long that my partner has this joint claim as she is intending on going back to work part time.

    They should already have the information. If there's any issues you can request your personal information that they hold on you. When doing this you need to make sure you include the date the decision was made on the WCA. https://www.gov.uk/guidance/request-your-personal-information-from-the-department-for-work-and-pensions

    When your partner starts working your UC will still remain as a joint claim because you're living as a couple and this will not change because they are working. Your UC entitlement will be based on your joint circumstances, the same as it is now.

    Hi poppy thank you for your help, I us d that link but I don't think I can use it as I don't have the date of my wca, everything I had was on my journal which has now disappeared along with all my old payments. I had an appointment with my partner to go in and talk to them but now they've cancelled mine.

    Them cancelling your appointment is a very good sign that they are already aware that you have LCWRA.
