Cont based ESA to UC managed migration LCWRA

I know this should be right but just checking becuase the job centre and UC helpline are saying I need a fit note.

If I am moving from Contributions based support group ESA because of managed migration from tax credits I should go straight into LCWRA group WITHOUT needing a fit note. I think this is regulation 19 of transitional protection.

Is this correct? I’m sure it is but everyone is still saying I need a fit note which I have read can trigger a new assessment

    You do not need a fit note because you're entitled to the LCWRA element from the start of your claim. Requesting a fit note is just part of a new claim for UC. What's very annoying is the system doesn't detect that this is part of managed migration and you claim ESA. I thought that with managed migration there wouldn't be this issue but it's clearly it hasn't been resolved.

    Put a message onto your journal and tell them you're claiming ESA in the Support Group. Once the system updates with your information from ESA then your commitments will be updated and everything will be fine.

    thanks for the reply Poppy, I have put it on the journal and quoted regulation 19 so helpfully they will put me into LCWRA group from that, I also have my 1st commitments appointment on the phone on Thursday should I basically refuse to commit to anything?

    No problem. No, you shouldn’t refuse. I see from a previous thread that they’ve already agreed to telephone appointments. You need to wait until ESA send your details across, which can take a few weeks but it will be done. Then you will be asked to agree to new commitments, which will just be to agree to report all changes.
