Not due LCWRA arrears?
Good morning
I've been on lcw a number of years, was due a reassessment last year they sent out the capability for work assessment form and I have been submitting fit notes with no gaps since 27th September, had my assessment on 19th June and have been awarded lcwra a week later,
I left a note in my journal asking will I receive back payment after the 3 month assessment period, so from January to June, they have replied back saying this..
You are not due any arrears, this is because your Limited capability for work and work related activity decision was awarded to start within the award period of your LCW award as done as a review case.
Is this correct what they are saying?

Assuming because you’ve been providing fit notes that you reported changes to your health condition that prompted them to refer you for another WCA? If so then they are incorrect, the extra money will be paid from the assessment period in which you reported the changes.
In cases where the review was started by UC then the extra money is paid from the assessment period in which the decision was made.

No they left a note on my journal saying I was due another assessment as it had been a number of years since my last one and were sending a form out. I sent it back and was supplying the fit notes (with the same health conditions)
So it's looking like the latter in what you say then and I won't be due any arrears?

I sent my assessment form off in early October after having a journal message in September saying they were sending one out as I was due another assessment, they said I had to keep sending fit notes until I got my assessment date, Yes my conditions are worse now than my last assessment.
The strange bit is though that I got a journal message when I sent my last fit note about a week before I got my assessment date saying I was awarded LCW and not to send any more but then had my assessment and was rewarded LCWRA?

As it was UC that started the review you wouldn’t have needed to send any fit notes because you still had LCW at that stage.
Unfortunately because they started the review there’s no money owed and the extra is paid from the AP in which the decision was made.
