Just had my work capability assessment today, if I am deemed not fit to work will the additional payment still be means tested as currently due to husbands work I don’t qualify for any Universal credits. Have enough national insurance credits to receive ESA as has an erratic few years of work due to current health conditions I can no longer work with. Currently on my UC claim it says we earn around £1000 a month too much to get any support so if I am found as Limited capability For Work Related Activity would this still mean that there is no financial support for me?

    UC is one payment made up of different elements and all of UC is means tested. You will only receive extra money each month if found to have Limited Capability For work Related Activity. (LCWRA) If found to have Limited capability for work. (LCW) you will not receive any extra Money.

    If you don't have children on your claim then at the moment you will not be entitled to the work allowance.

    If found to have either of those you will also be entitled to the work allowance. This means you and your partner will be able to to receive a certain amount of earnings each month before the 55% deductions apply.

    If you claim for help with the rent it will be £404/month, if you don't then it will be £673/month. For every £1 of earnings over those amounts then your UC will reduce by 55p.

    Hi thank you for reply. So assuming if found LCWRA I would be entitled to the extra 416.19 a month. Currently receive nothing due to husband’s salary but if I received the extra payment would I be right in saying I would have some entitlement.


    2288(salary) -673(don’t claim for housing costs) =1615 x 0.55 = £888.25.


    £888.25- 617.60 = £270.65


    The extra payment of £416.19 - £270.65 

    =£145.64 


    This is my understanding so could be totally wrong with calculations.

    If found to have LCWRA your UC would be as follows..

    Standard allowance £617.60 + LCWRA £416.19 = £1033.79/month before deductions.
    Earnings £2228 - £673 work allowance = £1,555 x 0.55 = £855.25 deduction.

    Amount of UC payable £178.54/month. As UC is based on earnings received each month then that amount can fluctuate depending on how much earnings exactly.

    If found to have LCW there would still be no entitlement to UC even with the work allowance.

    Are you claiming a disability benefit such as PIP/ADP daily living or DLA mid/high rate care?

    Hi, yes getting the lowest rate of daily living ADP but have a change of circumstances form in as health has changed significantly over the last 6-8 months. Were managing with the daily living component and partners wage but things starting to get difficult hence why started putting doctors lines into UC.

    Your partner can claim carers element of UC for looking after you, assuming they do so for at least 35 hours per week. This will increase your maximum UC entitlement by £198.31/month. It won't make any different to your claim now but it will if you're found to have LCWRA. There's no earnings limit to carers element like there is with carers allowance.

    To claim it they will need to report a change of circumstances and click "caring for someone" and then report caring for you through there.
