    Good morning,

I am writing this on behalf of my mother in law.

She’s currently receiving UC with the limited work capability as she suffers with anxiety and depression.

Her 18 years old daughter is entitled to PIP as she’s disabled. This year she has left education and we reported the change to UC. Now, my mother in law has received her monthly statement and there’s nothing about her daughter. She was expecting to have some reduction but she thought because the daughter still lives with her and being disabled she would still get some money for that.

Could you please advise? Thank you in advance

Hi there @gabriella1996 I just wanted to let you know I've split your question off into a separate discussion, just to avoid any confusion. I hope that's ok? 😊

I’ve just had to migrate to Universal credit and my 18 year old was only on my claim for 4 days when his A level course officially ended. He started full time work so I’m no longer entitled to any help.

I was informed by child tax credits that even though he started work I would still be entitled to claim for him until September as he had officially completed the full educational year, and would of been entitled to tax credits until 31st August even though child benefit was stopped the week after he started work. But it was stopped due migrating to universal credit.

My situation is different as my son started work so it may well be her daughter could stay on the claim until August 31st but if I’m honest Uc is a mine field and it’s all depends on personal circumstances.

Her daughter has left full time education so there's no entitlement to any money for her daughter on her UC claim. As she's left full time education she's no longer a dependent child and is now treated as an adult in her own right. This also includes the disabled child element because she's no longer a child.

The daughter can claim UC in her own right. She will need to make sure she reports her health condition and provides a fit note when she claims.

That advisor you spoke to about tax credits was incorrect. Even if you were still claiming Tax credits because your son had finished full time education and started working full time then your tax credits for him would have ended.

Hi, thanks for getting back to me! This makes complete sense. We will look into getting the daughter to apply for UC herself. Thanks again ☺️
