Seriously Confused !! Please help If you can 🙏🏻
Hi Everyone
This Is extremely confusing 😕 I would appreciate any advice. I had my PIP REVIEW, and went from being on Standard for both. To scoring 0 points, on my assessment. The Report showed a number of discrepancies, so I asked for a Mandatory reconsideration. I also complained to Capita, as the Assessor, wasn't thorough at all. And totally disregarded my Mental health conditions. Capita apologised, and gave me a New Assessment. I scored 15 points for Daily and 20 for Mobility. Since this assessment, I have been awarded Standard for both, which I was originally on. The Decision Maker said, I have used all the evidence available. And I have Increased your points, to be able to award you Standard for Daily and Mobility. What Im really struggling to understand is, If I had a 2nd Assessment. And scored 15 & 20 points, how can she have Increased my award to Standard. When I was given these higher points, on the 2nd assessment. It sounds like she has disregarded the points from the recent assessment. And then said, she Increased the points, from the results of the 1st Assessment. Apologies Its very confusing 😕
Please can anyone shed any light on this situation ? Thanks so much

Yup, they increased the points between the first and 2nd assessment. Before a decision is made they are supposed to look at all evidence, including the assessment report and then come to a decision.
Mostly they do go with the report but it has been known for them to against it and I've seen this happen many times here.
If you disagree with the decision you can request the Mandatory Reconsideration. (MR) You should put that in writing stating where and why you think you should have scored those points. (please do not ring to request it) If the MR decision doesn't change you can proceed to Tribunal.

Hi Poppy
Thanks ever so much for your advice. Can I please just clarify, are they actually allowed to do this ? I honestly thought that they would have used the most recent report. To determine if I would be awarded ? I dont understand how they can use both. And say they have Increased my points. When they have already been Increased, on the 2nd report ? Thanks Poppy

No problem. Yes they can because the report is a recommendation only. The decision maker makes the final decision.
