Up disability element.
Can someone help me please? I have realised today my son has been getting the low amount of the disability element on UC when he should have been getting the high amount (my child gets DLA higher care) I have been under paid for 2 years. I simply didn’t know there was two rates. I was originally on the middle rate care and then I got a letter saying they had made a mistake and I was going onto the higher rate. This was May 2022. I have still only had the lower rate on UC since then. What are my chances of it get back dated and has anyone got any advice to help me get the back dated payment please? I’ve struggled financially for years due to not being able to work because of my son’s disability and could really do with the back payment.

It will be paid from when you were entitled to it! If UC are not aware that he's claiming high rate care then you will need to report the changes. Report a change of circumstances and then click "children and other people that live with you" and then report it through there.
It may take a couple of weeks for a decision to be made but you will receive what is owed.
