    Hi. My son was refused PIP from DLA when he turned 16. I appealed it and we went to court a couple of weeks ago. The decision was overturned, and he got awarded enhanced on both elements.

    I am on UC and have given them a copy of the court decision. Will the child disabily element be back dated to the start of my claim? I had to change from legacy benefits to UC because his PIP was refused, and my caring responsibilities were removed. He was obviously cured when he turned 16 πŸ™„

    Hi @minisally, welcome to the community. Sounds like you've had a frustrating time in the transition to PIP. Sorry you had to go to appeal but it's good that you were able to get it all overturned.

    I'm afraid I'm not too sure about the backdated payments, but I'll pop your post into our Universal Credit section where members with the right experience can find it more easily. Hopefully someone's been through similar and can let you know how theirs worked out 😊 just wanted to say hello and welcome first!

    Yes, it will be paid from the start of your UC claim if it was awarded from then.

    You will need to wait for the PIP award to be put into payment, which can take anything up to 8 weeks. Once it’s in payment you will need to report the changes that he’s been awarded it.

    Also you will be able to claim carers element for them providing you’re not claiming the LCWRA element for yourself. You will need to wait for the PIP award to be put into payment.
