Pip partial back pay
Hi,
I lost my standard living pip last year (16 months ago) but kept standard mobility.
The court reinstated my standard living and upped my standard mobility to enhanced. I've received only the daily living backpay.
Am I right to think they can just keep me on standard mobility?
The court awarded enhanced mobility from 2022 but I can't see them back dating it for two years, but I thought I'd at least get it backdated for the past year since they started this roller coaster. It's been so stressful.
Is it usual to receive the components backdated separately or should I expect to only have the standard backdated.
Thank you

Hey @Scrapper and welcome to the community.
Congratulations on your award, that must be a huge reflief?
As far as back pay is concerned, as far as I know they'll usually pay it in one lump sum and you'll receive a letter breaking it all down for you. Though if the tribunal awarded you enhanced mobility, I believe you should've received the difference as backpay too?1 -
Thank you for your reply. I had a call about hospital etc but the automated system told me my next payment was lower mobility rate.
I haven't had any letters or anything but the amount I got in my bank is the amount of 15 months of standard living reinstated. I also thought they backdated both components together.
I guess they're refusing enhanced mobility. I already had 8 points but the court awarded me 18 points from March 2022. I don't even know if they can appeal just one component.
I thought I'd be awarded enhanced for the past year at least. My mobility is very poor, but I've been told the court decision isn't binding. It's all very confusing and very stressful.

DWP can't just refuse to pay your Enhanced mobility because you were awarded by the Tribunal. Not sure who told you the Tribunal decision isn't binding because that's not correct.
They can appeal the decision but only on error of law and before they can do anything else they need to request the Statement of Reasons (SOR) and Record of Proceedings (ROP). As they've paid you the daily living part then they wouldn't request either of those now.
The only way to know what's going on is to ring PIP in the morning when they open.
