Non dependent student

hello can anyone help with this. Very worried. My son came home to live he is a post grad student. I wrote to DWP to let them know because it affects my benefits. I have t heard back from them and no deductions. ESA legacy with sdp and pip exhanced hb etc. I sido write to council and they have sorted all out there end. I don’t want to e d up being investigated. Thank you.

    Unless your son is either registered blind or he claims a qualifying disability benefit himself such as PIP/ADP daily living or DLA mid/high rate care then you will lose the SDP.

    They don't always respond to letters unfortunately, for this reason if it's possible I'd advise you to ring ESA to report the changes.

    Hi @greendreamer, I hope you're doing okay today. As Poppy says it can sometimes be better to call them to get a more immediate response, as letters can either go without respond or take a long time to be given a response.

    You've done the right thing by informing them, they would investigate if you had not told them, so telling them should avoid any such action!

    How old is your son can I ask? As sometimes the age of the adult dependent can change the outcome of what you can receive.

    There would only be entitlement to SDP in this case if the criteria applied that I mentioned above.

    To remain entitled to SDP if the adult child is still in education then you would need to be claiming either child element of UC, child benefit or child tax credits for them. That wouldn’t be the case here due to being a post graduate student.

    thank you for responding. I’m too frightened to speak by phone to them as it seems to trigger compliance interview in past with abusive DWP staff. I don’t hear or speak well at best of times. They terrify me and it makes my speech worse.

    I’ve written another letter so there is a paper trail. I keep post receipts. I did notify them within two weeks of change.

    I appreciate you all taking time to reply. And confirming that they will take money away. My son is past age of child benefit etc.
