Hi guys, what do we need to do in our journals with this, as I have not had a response from my case manager with regards to this since a few months back, and not sure what I need to write in my journal now about this and how and when will they be looking at sorting this out, I guess it is going to be a long time before they can rectify and backdate all the claims, any advice of what I need to pop in my journal would be brilliant, this is really good news!!

    So sorry for late reply.
I’ve just basically quoted the case reference number and copied & pasted the outcome of the UT decision in the case.
Then I’ve added when I was awarded LCWRA and the date I requested my mandatory reconsideration which I STILL haven’t had a decision for.
I’m still waiting for a response to this latest journal entry.
keep me posted how you get on x

    hi @poppy123456

Just wondered if you’re able to point me in the right direction please ?

I requested a mandatory reconsideration 4/11/2024 regards this issue and I’ve still not been given a response. I’ve chased them continuously each month on my journal but still nothing from them.
Can you suggest my next move please ? Don’t have a clue where to go from here.
any advise would be appreciated thanks 🙏🏽

I am having same trouble I had a response saying its gone to MR with the information I have given about the tribunal etc and they said they cannot put a time limit for a response on it so I assume I have got to now sit and wait but thought surely there has to be a time scale they have to reply by? I reckon they are going to have loads of cases like this now and I still dont think this is common knowledge everywhere when it should be xx

Poppy123456 is taking a break from Scope at the moment.

Unfortunately I would expect a long wait for this. There are a lot of people in the same position and that will add to the already stretched workload of the DWP staff.

You could ask your local MP if they can speed up the process if you're having considerable difficulty with finances at the moment, though obviously that won't work for everyone and may not be possible at all.

Sadly the DWP generally don't have timescales on their side (despite forcing them on us!) but even when they do have timescales, such as with tribunal responses, there is no consequence to them for missing the deadlines, and in my experience they don't keep to them anyway.

Sorry, I know it's difficult not knowing how much longer you'll have to wait, but there really isn't much you can try to speed up the process.

I’ve had a decision on my mandatory reconsideration.
The decision is to not change my total erosion of TP by LCWRA due to it being within current legislation.
Im not sure how they can state this after the UT ruling ?

    @malvinmulch

Did you have any response yet ?

That's disappointing. I wonder if it's because you requested the MR before the UT ruling?

Your next stage of appeal is to take this to a tribunal yourself to challenge the MR. There should be details of how to do that on your decision letter.

Thank you for your response. I’ve followed the appeal process on line . Not entirely sure if I’ve worded it right though 😂 - however I’ve quoted the UT ruling so hopefully they get the gist of my reason for appeal. I’ll be sure to update when I hear back
