    i was having a look online just now and on the parliment uk site it says

    (((((Exceptions to serving the relevant period The requirement to serve the relevant period always applies except where: 1. the claimant is terminally ill 2. there has been a previous award of Universal Credit which included limited capability for work or limited capability for work and work related activity and either: a) the Universal Credit claimant becomes a single or joint claimant as a result of couple separation or formation b) the claimant's Universal Credit award ends, when their income or earnings exceed their entitlement and they claim again within 6 months 3. the claimant has a continuous claim from employment support allowance to Universal Credit or is still entitled to New Style Employment and Support Allowance with the support component or work-related activity component. )))))

    so i come under number 2 — there has been a previous award of lcw

    but at the end of the 2 sentence it say AND a b or c

    i only fit the sentence 1 ,not a b or c

    if i ask for mandatory r.they may decide to put me back on lcw ?

    if 2 people who work there have said i have to wait the waiting period out then it makes me think so will the next one

    do i need to fit sentence 1 or 2 AND a b or c.

    i, worried about asking for mandatory r as i have read that they may put me back on lcw.

    I think the last 4 comments of yours above may have got caught in the spam filter yesterday and the scope team have only recently posted them because I answered those questions last night.

    hi, thats fine ,no worry about spam filters.

    just to say in case of interest to anyone else in same boat ,they said their information is different to what i have been told on here and they will send it to a decision maker to look at.

    i not sure how long that will take though as they did not say.

    What do you mean by their information is different to what I advised you? The advice I gave you is part of the UC regulations 2013, which is the law.
