hello

i hope someone can please give me some help.

i was on universal credit in the lcw group but after being sent a review form by the dwp i then received a letter on my account saying that i have now been placed in the lcwra group . the decision letter was dated the 12th of july.

someone did say that as i was already in the lcw group then i did not have to wait 3 months for my first lcwra payment

so i was expecting a higher payment on my payment due date (the 19th of august) but when i checked my statement today it says that the august payment is still the same as that which i received in the lcw group. £393.45

have i got something wrong,i am finding it very confusing and dont know what to do

does the lcwra pay the same amount as lcw or should i receive a extra amount

thankyou

You are correct and there's no waiting period for you because you already had LCW.

Put a message onto your journal and tell them that the LCWRA element hasn't been included in this months statement when it should have been.

yes i will do that ,thankyou

should i have had the first payment this month/august and should i have had any back payment.

i received my decision letter on the 12th of july saying i had been put in the lcwra group thankyou

If your payment date is 19th of every month then that means your assessment periods are 13th to 12th of every month. As the decision was made on 12th July, this was the last day of the June/July assessment period and first payment should have been 19th July.

I wouldn't have expected the payment to be included for last month due to the decision being made at the end of your AP. I would have expected it to be included this month.

Therefore they owe you for last month and this month, so 2 months.

    hello all

i just received a reply on my journal saying that i have to wait 3 months for my first payment.

i dont know what to do as the official reply off the dwp is that i have to wait 3 months. are they wrong?

    the reply said

    AFTERNOON

LIMITED CAPABILITY FOR WORK RELATED ACTIVITY WAS AWARDED FROM 8TH JULY 2024.THIS IS NOT PAID FOR THE FIRST 3 ASSESMENT PERIODS FOLLOWING THE AWARD.

    14TH JULY TO 13TH AUGUST 2024

    14TH AUG TO 13TH SEPTEMBER 2024

    14TH SEPTEMBER TO 13TH OCTOBER 2024

    REGARDS

No, this is not correct. As I advised above, you already had LCW so the waiting period doesn't apply to you. Put a message onto your journal under the payment section and remind them that because you already had LCW the waiting period doesn't apply.

    hi poppy

when i click on payments it just shows my monthly payments.i cannot find anywhere on there to click to send a message

should i just send another message on the journal page or should i reply to the same person who sent me the first message saying that i have to wait three months

You don't click on payments to put a message onto your journal. Payments are for your statements.

Log into your journal and click "journal" From there look through the list and choose "payments" at the top and put your message there.

hello, i received a reply from a different person but i dont understand it at all except that it says i have to wait the 4 months until i receive first payment. here is the reply below.

As there was no relevant period applied when you were originally awarded Limited Capability for work (LCW) the period is applied when you were awarded Limited capability for work and work related activity (LCWRA). This is in line with UC policy and the LCWRA payment would not come into payment until after the 3 month relevant period has been applied.

    hello,just to say

i have just been put in the lcwra group but before that i was in the lcw group and before that i was in another group where i go to the jobcentre to see them about looking for work.

are there only 3 universal credit groups? the lcwra, the lcw,and the fit to look for work group ?

when i was in the lcw group i was sent a capability for work assessment form to fill in and it was decided that i am now in the lcwra group.

i dont understand the reply i received.it says i did not do the 3 month waiting period when i was awarded lcw.

They are still incorrect here. There's no relevant period when moving from LCW to LCWRA. I'd advise you to request the Mandatory Reconsideration on the decision not to pay the extra money from the assessment period in which the decision was made. You can do this on your journal.

Tell them you would like to request the MR because it's your understanding that there's no relevant period when moving from LCW to LCWRA.

    hi poppy thanks for help

i was just looking and it says

(((( Exceptions to serving the relevant period The requirement to serve the relevant period always applies except where: 1. the claimant is terminally ill 2. there has been a previous award of Universal Credit which included limited capability for work or limited capability for work and work related activity and either: a) the Universal Credit claimant becomes a single or joint claimant as a result of couple separation or formation b) the claimant's Universal Credit award ends, when their income or earnings exceed their entitlement and they claim again within 6 months 3. the claimant has a continuous claim from employment support allowance to Universal Credit or is still entitled to New Style Employment and Support Allowance with the support component or work-related activity component. ))))

excuse me for keep writing extra bits but after looking online i am worried that if i ask for a mandatory r that they may then take the lcwra away from me and put me back in the lcw group

I've not been online for a while. When you post a question it may not always be possible to have an answer straight away. The advice I give here is done in my own spare time freely and I also have health conditions myself.

None of those reasons you mentioned above apply to you. When you were found to have LCW there was no extra money if your claim started after April 2017.

Requesting the MR on the decision not to start the LCWRA element from the assessment period in which the decision was made will have no affect on the LCWRA decision itself.
