Transitional Protection will be lost if LCWRA??

Hi

Will be migrating over from tax credits. I receive NS ESA support group and PIP enhanced x 2. My mum receives carers allowance for me.

Due to capital limits we will only be entitled to UC for 12 months.

Today i have read though that if you have LCWRA you lose transitional protection. Is this correct? Or is it a case of if you have a change in circumstances and then are awarded LCWRA later not at the start then you lose transitional protection

I am aware that due to ESA £ for £ will be taken off UC.

    This only applies to those that don't already have LCWRA because when other elements increase or you become entitled to other elements the TP decreases by the same amount. Therefore with the additional element it could decrease TP to zero but it does depend on how much TP a person is claiming.

    As you're in the Support Group for ESA then you'll be entitled to the LCWRA element from the start of your claim so the above is irrelevant for you.
