Hello,

i was very fortunate to have a paper based decision on my review. On my ar1 form i did list all problems and where there had been changes i said how these affected me and give examples and supplied more recent xray reports stating how my spinal arthritis is now extensive.

The question i have is based on the decision letter it states that my health conditions (i have several) do cause chronic severe disability. It further goes on to say that i have restrictions in lower limbs BUT no restriction of my spine or upper limbs, this is where i am concerned that all medical evidence highlights the issues with my spine and yet they say i have none. Should i ring and tell them that i do have spinal issues or just leave it alone.

They kept my award the same and for an ongoing period i do think that i should have got enchanced care as my spinal problems are now extensive and do find my ability has got worse since i was last assessed in 2019 but to be honest i just dont think i could manage a MR.

I am really concerned that they say no spinal restrictions when from xray reports etc it clearly states its now extensive should i correct them without asking for a MR, if so how would i do it

    PIP isn't awarded based on any diagnosis. It's how those conditions affect you against the PIP descriptors that count. If you rang them about what was or wasn't in the decision letter then they may take that as an MR request. I don't think there's a way around this without challenging the decision.

    If you think it's possible to score more points for a higher award then you should request the MR. The most likely outcome of that will be the decision won't change as most don't. If this happens you can proceed to Tribunal, where about 70% of decisions change in the claimants favour.
