You were advised correctly about NsESA and yes it would be deducted in full from any UC entitlement the same as it is now for your husband. I believe I advised you that earlier in the year.

What I'm advising now is that because your husband is reaching state pension age next year you will be known as a mixed aged couple. This means that his state pension will be deducted in full from any UC entitlement.

How much is deducted will depend on how much his state pension is but the deduction could be more than what it is now for ESA. If it's full state pension then the deduction will definitely be more than it is now.

If you claim NsESA now you maybe better off when he claims his state pension but it does depend on the exact figures of your UC entitlement. I don't know what that is because I don't know how much housing element you're receiving.

The housing element we are getting is £574.29 and we think he will be getting full state pension as he has 38yrs of NI contributions.

Thank you for all your help on this
