Uc Migration- Carers Element affect Attendence allowance and TP

Uc migration due shortly from tax credits.

Have capital (assets over 16k) so only a 12 month entitlement
Joint claim: Couple- with one on PIP enhanced x2 and NS ESA (support group): would be LCWRA. Partner self employed, but possibly thinking to claim carers element for father who gets Attendance Allowance. Wouldnt have been eligible for carers allowance due to income threshold weekly.

Fathers AA- does not get SDP. Gets Pension credit. Part of a couple. Would his AA be affected/ read that council tax support may be affected- how??

Is it better to claim carers element from start of UC claim or add it once claim is being paid. I understand there should be no benefit cap, no MIF and should be found not GSE.

Don’t want transitional protection taken away if an element is added or taken off at some point as due to capital of over 16k, only eligible to claim for 12 months.

    Carers element will not affect the AA. However, if the fathers partner has an underlying entitlement to Carers allowance then your partner will not be able to claim carers element for looking after his father.

    If they stop the carers allowance underlying entitlement then this will affect Pension Credit, which could also affect other benefits such as housing benefit, council tax reduction and the Winter Fuel Payment.

    If they do not have an underlying entitlement to it then your partner can claim carers element from the start of your claim. It will not affect any TP you maybe entitled to for UC. It will only affect it if it was claimed from the 2nd assessment period because adding an element, decreases the TP by the same amount.

    The benefit cap doesn't apply anyway, even without carers element because of the LCWRA element for yourself.

    Please also be aware that if your capital drops to below £16,000 and then goes back above it within the 12 months then your UC will end.
