UC and LCWRA

Hi all. I migrated from Working Tax credit to UC and had a transitional protection of £406.42 per month. I completed the UC50 form, gathered a lot of medical evidence, and went through a difficult Work Capability Assement. I was glad when I received the letter that I have been awarded LCWRA. This month I checked my entitlement and I got the LCWRA element of £416.19 per month, however they have reduced the transitional protection to zero. So financially I am only better off by £9.77 per month. Surely this cannot be correct. Can anybody offer any explanation. Thanks in advance

    Unfortunately, it is correct. With Transitional Protection, when other elements increase or you become entitled to other elements, the TP decreases by the same amount. See link and scroll to erosion.

    According to my understanding, if you are awarded LCWRA then there will be 'No search for work commitments' and 'No fit notes to be submitted'. There is extra money for LCWRA, but in my case this has been off-set by a reduction in the Transitional Protection. Are there any other benefits of LCWRA?

    Your understanding is correct. If you or a partner are receiving earnings and you didn't previously have the work allowance you will now be entitled to that.

    Also free prescriptions, dental and eye tests if earnings are £935 or less in your previous assessment period, where as prior to this decision it would have been £435 or less.

    You're welcome. When you were claiming WTC did it include the disabled element?

    Yes, disability element was included in WTC

    Thank you. I do know that there's a high court hearing expected at some point regarding those migrating from WTC to UC and losing their TP due to the LCWRA element being included after going through the work capability assessment.

    Of course this won't be decided overnight and it will take time but I will definitely post something if there's any news in the future.
